Moraes grants provisional release to 90 prisoners on January 8

Minister Alexandre de Moraes, of the Federal Supreme Court (STF), granted provisional release to 90 defendants who were arrested for their participation in the January 8 acts. The decision was informed by the Court on the night of this Monday (7). Despite this, the group – 37 women and 53 men – will have to comply with a series of precautionary measures. The Supreme Court did not inform how many people are still being held because of the episodes of vandalism to the headquarters of the Three Powers.

According to the STF, Moraes ordered the replacement of pre-trial detention by provisional release because he understood that “the current possibility of reiterating the crime was no longer present and the risk of interference in the production of evidence was no longer present”, due to having already if the procedural instruction phase is closed. Previously, the alleged reasons for maintaining these prisons were the “guarantee of public order” and the “convenience of criminal instruction”.

They answer for the crimes of armed criminal association, violent abolition of the Democratic State of Law, coup d’état, damage qualified by violence and serious threat, with the use of flammable substance, against the patrimony of the Union and with considerable damage to the victim, and deterioration of listed heritage.

The precautionary measures determined by the minister were:

“(i) Prohibition of being absent from the Judicial District and home collection at night and on weekends through the USE OF AN ELECTRONIC Anklet, to be installed by the Federal Police in Brasília/DF, IN THE TERMS OF INCISO IX OF ART. 319 OF THE CRIMINAL PROCEDURE CODE, with an inclusion zone restricted to the fixed address indicated in the complaint;

(ii) Obligation to appear before the Court of Execution of the District of origin, within 48 hours and weekly attendance, every Monday;

(iii) Prohibition of leaving the country, with the obligation to deliver their passports to the Judgment of Execution of the Judicial District of origin, within 05 days;

(iv) CANCELLATION of all passports issued by the Federative Republic of Brazil in the name of the investigated person, rendering them void;

(v) IMMEDIATE SUSPENSION of any firearm possession documents on behalf of the investigated person, as well as any Registration Certificates to carry out firearms collection, sport shooting and hunting activities;

(vi) Prohibition of use of social networks;

(vii) Prohibition of communicating with others involved, by any means”.
