Moraes foresees judgment in 6 months at the STF of those involved in the 8/1 attacks – 06/13/2023 – Power

Minister Alexandre de Moraes, of the STF (Federal Supreme Court), said this Tuesday (13) that he intends to judge in six months the cases of people accused of participating in the coup attacks on January 8, but admitted that it is possible that this deadline is not met.

For this, according to the minister, he has held meetings with the PGR (Attorney General of the Republic) and intends to divide them into blocks of 30 complaints because many witnesses are the same.

Moraes outlined an overview of the progress of criminal actions resulting from January 8 at an event promoted by Piauí magazine and YouTube this Tuesday morning (13).

He stated that he is awaiting the prior defenses of the accused to see the number of witnesses who will be listed. He understands that the so-called background witnesses will not be heard, but may attach written documents to the process.

A witness of this type is called by the defense to prove the defendant’s conduct. Generally, they do not know the facts and speak only of the suitability and conduct of the person.

“I hope that, in up to six months, all the processes will be finished. The deadline may pass because we still haven’t been able to finish the very end of receiving the complaints because some have been changing lawyers. But at least the 250 prisoners who are the most serious crimes in these six months the supreme will close”, he said.

Moraes also refuted accusations made by the defenses of the accused who allege that the parts of the processes are weak because they do not point out individual conduct. He said that anyone who claims this “doesn’t understand anything about criminal law”.

“If now a fight starts, one hitting the other, I don’t need to say that the person destroyed the chair, scribbled on the carpet. These are multiple conducts. You need to individualize, prove that you were there, participated in the depredation and that there was depredation. You don’t need to say who scratched the frame.”

Moraes also stated that all complaints were cited by the prior defense and that he had the job of analyzing each one, such as who entered Congress, the executive branch or the STF.

“There is nothing to describe more, what the defense has been saying, it will say that I was not there, that I did nothing. Being there is already a crime, but if you prove that you did nothing through the cameras, some crimes fall away”, he said.
