Moraes fines Telegram R$ 1.2 million for not blocking Nikolas Ferreira’s account

The Minister of the Federal Supreme Court (STF) Alexandre de Moraes fined Telegram this Wednesday (25) BRL 1.2 million for failing to comply with the order to block the account of elected federal deputy Nikolas Ferreira (PL-MG). In the decision, the magistrate stated that “there is no justification” on the part of the platform “for the partial non-compliance with the judicial decision handed down”.
The minister had determined the blocking of several Telegram accounts, but Ferreira’s was not blocked. In a letter sent to the Court, the lawyers defending the platform would have criticized the STF orders on content removal.
“The social network Telegram, by failing to comply with the court order, directly questions the authority of the court decision taken in the context of a criminal investigation, understanding the right to assess its legality and the obligation to comply,” wrote Moraes.
“Like any private entity that carries out its economic activity in the national territory, the Telegram social network must effectively respect and comply with direct commands issued by the Judiciary regarding facts that occurred or with their perennial effects within the national territory; it being up to him, if he deems it necessary, to demonstrate his non-conformity through the resources allowed by Brazilian legislation”, he added.
Moraes determined the blocking of the elected deputy in an investigation into anti-democratic acts. The minister stated that the decision “does not constitute any prior censorship, constitutionally prohibited even because there is no prohibition on those investigated to manifest themselves on social networks or outside them, as several continue to do, not infrequently repeating the same criminal conduct”.
The magistrate also said that freedom of expression cannot be used as a “protective shield for the practice of illicit activities”. Moraes gave Telegram five days, counting from the subpoena, to pay the fine.
