Federal Supreme Court Minister Alexandre de Moraes imposed a millionaire fine on the Telegram application for non-compliance with a decision.
The social network failed to comply with a court order to block the channel of elected federal deputy Nikolas Ferreira (PL-MG). As a result, the minister established a fine of R$ 1.2 million.
Alexandre de Moraes had determined, on January 13, that Telegram would interrupt Nikolas’ account in Brazil. The magistrate stipulated a daily fine of R$ 100,000 for non-compliance with the determination. The fine refers to ten days of non-compliance.
“The social network, by failing to comply with the court order, directly questions the authority of the court decision taken within the scope of a criminal investigation, understanding the right to assess its legality and the obligation to comply with it”, says Moraes in the decision. .
Earlier, Telegram asked the minister to reconsider the order to block the elected deputy. In an official letter to the STF, he said that there was “no basis or justification for the full blocking of the said channel”.
Telegram also criticizes the blocking order and says that the determination “collides with the right to freedom of expression”.
On his channel, with more than 306,000 subscribers, Nikolas thanked Telegram for “fighting against censorship”.
“The only ‘social network’ I can still communicate with. They literally want to disappear from the internet. Surreal,” wrote the elected deputy.
When contacted, Telegram did not respond to the report’s contact.
In March 2022, Moraes even suspended the operation of Telegram in Brazil. At the time, the minister responded to a request from the Federal Police.
The block was revoked after the application responded to the demands of the STF: it appointed a representative in the country, Alan Campos Elias Thomaz, closed a partnership with news checking agencies, in addition to guaranteeing that it would restrict posts that spread misinformation.
