Moraes denies request and maintains tenure of 11 Bolsonarist deputies – 01/29/2023 – Power

Supreme Minister Alexandre de Moraes denied the request to suspend the tenure of 11 elected federal deputies suspected of involvement in coup acts. For him, it will be up to the Board of Ethics to deal with the issue. In this way, they will be able to take possession of their mandates next Wednesday (1st):

Moraes also denied the request to open a new police inquiry for lack of just cause, according to the minister. The requests were made by the Prerogatives group of lawyers. The group of jurists argues that elected and re-elected congressmen endorsed the terrorist acts carried out on January 8 in Brasília.

“At this time, any consequences of the conduct reported in relation to the terms of office of nominated Federal Deputies should be analyzed within the scope of the Ethics Council of the Chamber of Deputies, pursuant to article 55 of the Federal Constitution”, says Moraes in the decision. The minister also asks that the mayor, Arthur Lira (PP-AL), be officiated for the adoption of the measures he deems appropriate within the scope of the House collegiate.

The minister had made a request for the PGR (Attorney General of the Republic) to comment on the Prerogatives’ request on the suspension of the tenure of federal deputies.

Yesterday, the MPF positioned itself against the request. At the demonstration, the Deputy Attorney General of the Republic Carlos Frederico Santos recalled that deputies have constitutional prerogatives, formal and material immunity, as provided for in the Constitution, since the diplomation, which took place in December.
