Minister Alexandre de Moraes, of the Federal Supreme Court (STF), determined this Wednesday (10) the suspension of the Telegram messaging application across the country for 72 hours, if the company does not remove messages critical of the PL within one hour. of the Fake News that were sent to all its users this Tuesday.
According to the minister, Telegram’s action constitutes abuse of economic power on the eve of the project’s vote, for “trying to ILLEGAL and IMMORAL impact public opinion and the vote of parliamentarians”.
The minister determined that the big tech delete the messages sent to its users within one hour, counting from the subpoena of the company’s legal representative, and that it send, within the same period, a message to all users of the platform saying that it conveyed misinformation. The text to be sent says the following:
“By determination of the FEDERAL SUPREME COURT, the company Telegram communicates: The previous Telegram message featured FLAGRANT and
ILLEGAL DISINFORMATION offensive to the National Congress, the Judiciary, the Rule of Law and the Brazilian Democracy, as it fraudulently distorted the discussion and debates on the regulation of providers of social networks and private messaging services (PL 2630), in attempt to induce and instigate users to coerce parliamentarians”.
If this message is not sent, the platform will be suspended for 72 hours throughout the national territory. A fine of BRL 500,000 per hour is also foreseen in case of non-compliance. The minister also determined that the Federal Police conduct a hearing of the legal representatives of Telegram in Brazil.
Moraes says that Telegram is a “recidivist” in “proliferation of fraudulent messages”
Moraes also says, in the decision, that the company’s behavior “instigates” the “maintenance of various criminal conducts practiced by the digital militias investigated in INQ 4,874”, known as the digital militias inquiry, of which he is the rapporteur.
“Unfortunately, the company TELEGRAM INC. is a repeat offender
practices that, by act or omission, allow the criminal proliferation of
fraudulent messages”, says an excerpt from the decision.
Moraes also cited an article in the newspaper Folha de São Paulo to support that the statements contained in the message sent by Telegram to its users were “fraudulent”.
