Melo revokes more than half of outdated decrees in the Capital

During the first day of the South Summit in Porto Alegre, Mayor Sebastião Melo (MDB) electronically signed the repeal of 4,399 decrees, of the 8,749 existing, some since 1930. The reduction is equivalent to 50.25% of the total volume of decrees.
The municipality of Porto Alegre has a total of 17,256 norms, including laws and decrees. Claiming that it had the objective of making the public machine work more quickly, the city hall started a project to establish a new regulatory framework. The first stage of this reduction in bureaucracy planned for the capital of Rio Grande do Sul was achieved with the repeal of these decrees.
“A city, in order to have a good business environment, needs people to understand the rules of the game, the norms. Nobody enters into a dark game to undertake. These decrees made many areas of service and entrepreneurship difficult”, said Melo.
Among the more than 4,000 revoked documents, there are concrete examples involving the operation of the city. The opening hours of establishments, for example, had 16 decrees and now have three. Street vendors’ work used to be regulated by 19 norms and will now have just one.
Taxis evolve from 19 to seven decrees, while urban furniture reduces from 16 to 10. In the internal scope of management, the city hall had until then 708 decrees of structure and regiment. With the new logic, and considering the 29 existing bodies in the municipal administration, it now has only 29 structural decrees and 29 regimental decrees.
The set of actions cited by the mayor does not stop there. Melo is also preparing a repeal of laws – something that, unlike decrees, would need approval from city councilors. “It’s the beginning of a process. Now comes a second stage, which are the laws. A decree is what the Executive can do. The laws come from the Legislative. Sometimes, on the same matter, there are five, seven, eight laws. The second step is to compile, streamline and unify these laws”, warned the mayor.
As the manager of legislative activities, Luciane Pinheiro, explains, the accumulation of acts disrupts the real lives of residents and businessmen, who often have difficulty identifying which rule to follow, in addition to stifling the public machine. The revision includes acts from 1930 to 2021.
“This revoked set will provide faster responses to citizens, more agility to undertake and less bureaucracy in city hall processes. But the reduction is just the first step in the larger project of reviewing the effectiveness of the norms. The next step is to reassess the laws and propose changes to the Legislature in search of more efficiency”, he says.
One of the examples of modernization of the rule that yielded concrete results, mentions Luciane, is the new decree on the installation and use of parklets, issued last year. From 2017 to 2022, 242 installation requests were filed and only eight were completed. “The new decree simplified the procedures and, in less than a year, 33 parklets were authorized.”
