Accepting the thesis of the Electoral Public Ministry (MPE), the judgment of the 11th Electoral Zone of Pedra Branca do Amapari decided to revoke the diploma of councilor Fausto José dos Santos, current president of the Serra do Navio Chamber of Councilors, for buying votes in the elections de 2020. The Electoral Justice upheld the Special Representation filed by the then electoral prosecutor of the 11th ZE, Thaysa Assum de Moraes.
The Electoral MP instituted proceedings against the respondent because, after registering his candidacy for the 2020 municipal elections, he promised a group of approximately 30 students a personal advantage in the form of full funding for the graduation party, in addition to payment of sums of cash on election day, paid for the purpose of raising votes for his candidacy.
In addition to the promise, there was an effective payment of R$ 500 to one of the students, in charge of recruiting other students, payment made under the justification of “helping” in the graduation of the class.
The action was instructed based on the Auto de Prisão em Flagrante nº 2975/2020, and a series of screenshots containing conversations between some people caught and witnesses, extracted from the instant messaging application installed on the telephone devices seized in the police action, with authorization judicial.
After guaranteeing the contradictory and ample defense, the electoral judge Fabiana Oliveira condemned the cancellation of the diploma of the councilor, based on article 41-A, of Law 9.504/97, as well as declared the sanction of ineligibility applied for the elections to be held over the subsequent eight years. After the sentence becomes final, the alternate must be summoned for diplomation.
