Man fired after photo is hired by rival company – 07/19/2023 – Market

The 2nd Labor Court of Ariquemes, in Rondônia, condemned, on June 29, the soft drink brand Frisky to pay compensation of R$ 7,000 to a former employee who was fired after publishing a photo of his son’s birthday party . In the image, competitor’s bottles appear on the table.

After the repercussions of the dismissal, Keoma Messias Oliveira, 27, was hired by Dydyo Refrigerantes, a brand served at the celebration.

Keoma worked for 1 year and 3 months as a machine operator at Frisky and was fired on February 14th. The night before, he had celebrated his son Oliver’s 2nd birthday and posted a photo of the party table on his WhatsApp status.

According to Keoma, a company employee saw the image and shared it in a group with other colleagues. The photo would then have reached the company’s Human Resources area.

“My sister was the one who bought everything, including soft drinks. When I got home after work, everything was ready. I took the photo, posted it on WhatsApp and someone, out of envy or malice, threw this photo in the company’s group and got to the boss. The other day, I was fired”, he says.

Keoma says he only understood that the cause of dismissal was the photo after receiving an audio message from a manager admitting the possibility. According to the former machine operator, the justification he received from the company was a change in the staff.

According to the sentence of substitute Labor Judge Luciano Henrique da Silva, a Femar employee gave another justification during the hearing. She said that in January of this year there was a meeting with the board to reduce the staff, and that Keoma’s name was passed on in a report “because she was not having productivity”.

The judge, however, understood that the dismissal was due to the photo of the competing soft drinks at Keoma’s party.

“The claimant’s dismissal, although formally without just cause, had as real reason his son’s birthday photo, in which a competing product appears”, says the judge in the sentence. “It was uncontroversial that the farewell took place the day after the commemoration”, he adds.

The case gained repercussions on social media. The Dydyo brand profile received hundreds of comments calling for Keoma to be hired. The brand’s marketing sector looked for the former employee of the competitor through social networks in the last week and offered a vacancy in the logistics sector.

“They contacted me and asked me to go to the warehouse to talk to them. I was very well received and I’m very happy, dying to start working”, says Keoma.
