Magistrate organizing gatherings exchanges his toga for a gown – 12/15/2023 – Frederico Vasconcelos

Judge Daniel Carnio Costa, head of the 1st Bankruptcy and Recovery Court of São Paulo, ends his term as a member of the CNMP (National Council of the Public Ministry) and will work as a lawyer.

The decision was anticipated by Consultor Jurídica magazine. The judge was contacted by the blog. The CNMP press office informed that the counselor will not comment on the matter.

An award-winning economist and author of a respectable academic work, in the last five years Daniel Costa has been attracted to the red carpets of Brasília’s offices. He participated in the organization of several events that brought together judges, lawyers and businesspeople in the country and abroad.

Fellow magistrates criticize his long stay outside of his judgeship.

Costa was an assistant judge to Minister Humberto Martins at the National Justice Inspectorate (2018/2020) and as president of the Superior Court of Justice (2020/2022). He was an advisor to the CNMP (2021/2023) appointed by the STJ, chosen from a list of 24 state judges.

Graduated in Law from USP; Master’s degree from Fadisp and Samford University (USA), Costa completed a post-doctoral internship at the University of Paris 1 – Panthéon/Sorbonne. He was a member of the commission of jurists that drafted the reform of the Bankruptcy and Judicial Reorganization Law.

Consultant for the World Bank, trained magistrates in Angola, Mozambique and Cape Verde.

In 2018, he was elected jurist of the year by the Order of Economists of Brazil.

First flights

Daniel Costa’s schedule at events abroad drew attention when he was academic coordinator at Ibajud (Brazilian Insolvency Institute), lobbying law firms, judicial auctioneers, agribusiness and credit recovery companies.

In 2017, Ibajud took STF minister Alexandre de Moraes to give lectures on judicial recovery, in California (USA).

In January of this year, Costa created an event to discuss, in the tourist region of Tuscany, Italy, the attempted Bolsonarist coup in Brazil.

He obtained authorization from the then Attorney General of the Republic Augusto Aras to participate in a “higher training course in constitutional justice” at the University of Pisa. Tickets were issued (R$ 38.7 thousand) for boarding on 1/13 and return on 1/23 (R$ 25.2 thousand in daily rates).

The forum in Pisa took place on January 16th. Daniel Costa and TRF-1 judge Hugo Abas Frazão, a doctoral candidate at that university, organized the meeting. The debate in Siena was held on 1/24, broadcast online.

Federal judges Antonio Souza Prudente and Hugo Frazão, two exhibitors, had been in Italy for days, as they participated in the event in Pisa.

In May this year, the Legal Consultant and Ibajud promoted the Milan Forum 2023, to discuss judicial recovery and bankruptcy in a luxury hotel on the shores of Lake Maggiore, in Milan. The event was supported by the Brazil Europe Integration Forum (Fibe).

In 2022, the agenda of seminars in Portugal, with ministers from the STJ, records five events between April and July: Lisbon (two), Porto, Coimbra and Algarve.

The Ibajud Algarve 2022 Forum ended with dinner and a show in a casino. The official program allowed for another day to be extended to include a tour and lunch in Seville, Spain.

Minister Humberto Martins, former president of the STJ, gave a master class on business insolvency in Seville. The meeting was organized by judge Daniel Costa.

During an event in Porto, Costa launched the book (co-authored) “Comments on the Business Recovery and Bankruptcy Law”.

Still in 2022, the magistrate went to several other events abroad. He participated in the seminar “Post-pandemic Law” at the University of Valladolid, in Spain.

In Canada, he was elected president of the Judicial Committee of the “International Insolvency Institute”.

He attended a course in Italy on the protection of criminal victims. He gave a lecture in the Senate, in Rome, about the Covid-19 pandemic.

In Paris, he participated in the “1er Rencontre de Droit des Affaires”.

He ended the year in Argentina, speaking about “Globalization, Economic Crisis and Corporate Insolvency”.
