Electoral MP is in favor of the impeachment and ineligibility of Sergio Moro

The Regional Electoral Attorney’s Office in Paraná issued a favorable opinion for the impeachment of senator Sergio Moro (União-PR) and his substitutes on the ticket, this Thursday (14). The opinion also indicates that the ineligibility of the former Lava Jato judge and alternate Luis Felipe Cunha.

The manifestation of partial origin of the investigation action, authored by the Liberal Party and the PT-PV-PCdoB Federation, recognized the practice of abuse of economic power in the process that must go to trial at the Regional Electoral Court of Paraná (TRE-PR) in January, after the judiciary recessed.

According to the document signed by the regional electoral prosecutor, Marcelo Godoy, the procedural instruction proved the minimum investment of just over R$2 million in Moro pelo Podemos’ pre-presidential campaign, between November 2021 and March 2022, before the migration to União Brasil, the acronym through which the candidate was elected as a senator from Paraná with 1.9 million votes. The amounts contracted by the two parties were added together in the action, according to the prosecutor’s understanding, which exceeds the spending limit foreseen for campaigns in the state.

“The spending limit for candidates for the position of Senator in the 2022 Elections was R$4,447,201.54 and, according to information from DivulgaCand, the total expenses contracted by the campaign of those investigated was R$5,103,495.12”, compares the Electoral Public Ministry (MPE).

“When analyzing the amounts invested in the campaign by the other candidates for the Senate, the percentages are no less significant: the amount spent by those investigated in the pre-campaign represented 55.36% and 40.28% of the contracted expenses of the tickets placed in the second and third placements in the dispute, respectively, and 110.77% of the average investments made by the ten candidates for the Senate in the state of Paraná”, adds the attorney.

In the opinion, Godoy remembers the beginning of Moro’s political trajectory with “acts of personal promotion” in the national pre-campaign “with a great commitment of financial resources”, and later the former judge’s candidacy “turned to the state of Paraná , for a position with a much more modest spending limit.”

In the prosecutor’s assessment, this scenario “makes the pre-campaign of those being investigated abusive” due to the “massive investment of financial resources made for personal promotion”, generating great visibility of the pre-campaign to the detriment of the other candidates for the Senate. “This context demonstrates that the means used to carry out the pre-campaign and the amounts spent in this endeavor in favor of those investigated proved, in fact, to be unreasonable, assuming the contours of excessive use of economic power”.

The prosecutor also considers that the national projection of a public figure plays “a crucial role, even in elections at state level, influencing various aspects of the electoral process”.

The Public Electoral Ministry recommends the revocation of the ticket and the ineligibility of Moro and alternate Luis Felipe Cunha, a lawyer appointed by the former Lava Jato judge to the parties for legal advice during the presidential pre-campaign and for the Senate campaign in Paraná. The opinion calls for maintaining the political rights of the second substitute on the ticket, Ricardo Augusto Guerra.
