Lula sanctions the new structure of the Esplanada and vetoes the section that emptied the environmental area

The new law is the result of the bill to convert a provisional measure issued by Lula on the first day of his third term to give the Esplanada a new design.

Brasilia DF) – President Luiz Inácio Lula da Silva sanctioned the law that restructures the ministries and vetoed passages that he had promised the Minister of the Environment, Mariana Silva, to preserve the portfolio’s activities in strategic areas from an environmental point of view and prevent the emptying of the functions of the minister. Lula blocked passages that left the Ministry of Integration and Regional Development in charge of the National Water Resources Policy, the National Water Security Policy and the management of water resources, actions historically coordinated by the Environment.

“Despite the good intentions of the legislator, the legislative proposal goes against the public interest, since water management is a central and cross-cutting theme of environmental policy, of which water is one of the environmental resources of the National Environmental Policy”,

says the reason for the veto presented by the Planalto Palace to Congress.

“The successful implementation of the National Water Resources and Environment Policies, which historically in Brazil were developed in an aligned manner, served as a reference for the construction of state models for managing water resources and the environment, inspired by the model of the Union, facilitated the necessary articulation and alignment for the management of water in its different domains”,

Regarding the management of water resources, the government claims that the issue covers aspects that go beyond the guarantee of water infrastructure, “which presupposes understanding water as a public good, whose availability in quality and quantity, as an input for human activities, is inseparable from the maintenance of ecological processes and their interaction with adaptation to climate change.”

The new law is the result of the bill to convert a provisional measure issued by Lula on the first day of his third term to give the Esplanada a new design. The text, however, underwent several changes in the Chamber, disfiguring the original proposal conceived by the Lula government. The transfer of the National Water Resources Policy from the Ministry of the Environment to the Regional Integration and Development portfolio, for example, is a wish of the so-called Centrão, but much criticized by environmentalists. The changes in the text caused impasses and clashes between the government and parliamentarians, resulting, in the end, in an approval of the MP’s expiration date.

Lula also vetoed the device that established that the Ministry of Cities was responsible for planning, coordinating, executing, monitoring, supervising and evaluating actions related to sanitation and buildings in Indigenous territories.

“The legislative proposal goes against the public interest, as it would make the use of environmental sanitation and indigenous buildings unfeasible as environmental determinants of health, fundamental indicators to base decision-making on epidemiological data, as established by the National Policy for Health Care of Indigenous Peoples and would generate direct negative impacts on the health of indigenous populations”,
