Lula recognizes Gilmar and Moraes as negotiators at the STF – 11/28/2023 – Bruno Boghossian

Lula held a table with Gilmar Mendes and Alexandre de Moraes to define his nominations for the STF and the PGR. The move matters less because of the court’s political involvement in the articulation and more because of the characters that the PT member recognized as preferred negotiators in the court.

Gilmar and Moraes were nominated by PT opponents. Neither of them made a point of disguising their criticism of the party or their convictions that were far from the left.

If he had sought to impose an ideological brand, Lula would not have accepted the duo’s suggestion to place the conservative Paulo Gonet as head of the PGR. She also would not have created an alliance between the two and Flávio Dino before nominating him to the STF.

Even though the Supreme Court deliberates on the time frame, abortion and drugs, Lula does not see the court with concern in the ideological field — and this does not exactly seem to be a priority for the PT member. The president’s relationship with the court is based on political agreements that can guarantee stability to the government.

The rapprochement between Lula, Gilmar and Moraes is largely due to Bolsonarism. Recent years have redefined the alignment of STF members and created a cohesion driven by the self-preservation of the court’s powers.

He also mentioned the weight that the two ministers accumulate in the court’s game of influence. They lead internal articulations in large and small trials, in addition to exercising authority outside the STF, such as in appointments to relevant positions.

Six of the court’s eleven seats are occupied by ministers appointed by PT governments. Dino, if approved, will be the seventh. But Lula understands that this majority is not worth as much as the help that can be provided by foreigners Gilmar and Moraes (with the expectation that Dino will join them in this mission).

The PT member has the habit of wandering outside his political field when he sees benefits. He has already allied himself with José Sarney, swallowed an agreement with Arthur Lira and appointed conservative Cristiano Zanin to the STF.
