Lula loses lawsuit against Hang for banners on planes in 2019 – 04/26/2023 – Politics

President Luiz Inácio Lula da Silva (PT) lost a lawsuit against the owner of Havan stores, Luciano Hang, due to the financing of planes with messages critical of the PT in 2019. The decision can be appealed.

The decision, dated March 30, was handed down by Judge Rafael Espindola Berndt, from the 2nd Civil Court of the Judicial District of Navegantes (SC).

Lula filed a lawsuit, at the end of 2019, against Hang after the businessman’s publication on Twitter stating that he would pay planes to fly on the coast of Santa Catarina with “patriotic” messages.

The Bolsonarist would have financed messages on some aircraft, such as “Lula cachaceiro returns my money”, “Lula in jail, me with my foot in the sand”, “Better than summer is Lula in prison” and “Lula in a cage is Brazil awake” . On November 8 of the same year, Lula was released from prison.

The current president maintained that the banners were offensive to him and asked for compensation for moral damages. The state prosecutor’s office was against the claim for damages and the request that Hang refrain from paying for these tracks.

In court, the owner of the Havan stores argued that his post is backed by freedom of expression and indicated “prior censorship of Lula and the comic content of the publication” and messages on planes.

In the order, the magistrate argued that Lula is a public person and subject to criticism. For justice, the phrases conveyed by Hang have “a jocular, ironic and critical intention” and occurred at a time when the petista had convictions in Brazilian justice.

“Consequently, I understand that the dialectic of the concrete case is compatible with the current political game, in which barbs are exchanged between the actors in front of the general public, which, in this case, does not reveal the existence of indemnifiable damage to the author, falling to the own public opinion the judgment of disapproval or not of the acts practiced by the defendant in the present case”, pronounced the judge in the decision.
