Lira tries to censor vehicles, but judges deny injunction – 7/13/2023 – Power

The President of the Chamber of Deputies, Arthur Lira (PP-AL), has filed two lawsuits in recent weeks in which he requests, as a matter of urgency, the removal of journalistic content produced by the Public agency and the ICL Notícias channel, in addition to reparation by moral damages.

In both cases, the judges denied the requested preliminary injunctions, which included a request to ban the publication of new reports on the cited cases.

Lira’s advisory said he would not comment on the actions he filed.

The most recent action was filed on the 28th at the 14th Federal Court of Brasília against the investigative journalism agency Pública and the ex-wife of Lira Jullyene Lins.

The piece asked the Justice to order the Twitter, Facebook, LinkedIn and Instagram platforms to overthrow, within 24 hours, links to the report “Arthur Lira’s ex-wife accuses him of sexual violence”.

Lira asks for compensation of R$ 100,000 and that Pública and Jullyene be prohibited from publishing other publications with the same content, under penalty of a fine.

Publica reports in the report Jullyene’s statement that she had suffered sexual violence in 2006, on the same occasion that she previously claimed to have been attacked with kicks and punches by Lira — the deputy was acquitted of this accusation by the STF (Federal Supreme Court) in 2015.

In the petition, the defense of the president of the Chamber affirms that the report “was forged and conceived to severely affect” his honor “through the serial repetition of accusations” of a case already closed in Justice.

Judge Luis Carlos de Miranda rejected Lira’s injunction requests (the merit has not yet been judged), citing freedom of expression in the democratic State of Law without “retaliation or censorship by governments or public authorities”.

A week before this action, the mayor had already entered the 24th Civil Court of Brasília with a lawsuit for compensation for moral damages against Jullyene and the ICL Notícias channel, maintained by businessman and economist Eduardo Moreira and broadcast on YouTube and digital platforms.

As in the most recent case, there was a request for an injunction to remove videos broadcast on the channel on June 6 from the air. The claim for damages is R$ 300,000.

Among other points, the videos address the investigation by the Federal Police that points to the suspicion of misappropriation of public resources for the acquisition of robotics kits —and which targeted one of Lira’s main advisors— and the accusations made against him by Julyenne.

Judge Gustavo Fernandes Sales denied the preliminary injunctions, stating that the allegedly offensive content must be assessed “after due legal process”, avoiding the “risk of imposing true censorship on freedom of the press”.

Press associations repudiated the actions filed by Lira.

“It will not be by silencing journalists and press organizations that he will manage to improve his public image. Even more scandalous is knowing that the deputy was given space to exercise his defense, an attitude that he ended up despising”, stated the ABI (Brazilian Press Association) ).

“The denial of the immediate withdrawal of the reports, given by two different magistrates, is one of the signs of the parliamentarian’s mistake and exaggeration in dealing with the news and with the press professionals in a situation that certainly caused him discomfort”, he says. note jointly signed by, among others, Abraji (Brazilian Association of Investigative Journalism) and Fenaj (National Federation of Journalists).

Pública stated that its journalistic investigations are carried out “based on the rigorous investigation of facts in the public interest” and that it “repudiates the attempt at judicial intimidation with a request for prior censorship”.

In a video broadcast on his channel, Eduardo Moreira said: “Coming from anyone, [a ação] it would be worrying. Coming from the head of one of the three Powers, scandalizes.”
