Lawyer says victim recognized technician as aggressor

Willi Egloff, a lawyer who represented the rape victim in Switzerland in an episode involving coach Cuca, in 1987, denied the statements made by the Corinthians coach and said that the girl, then 13 years old, did recognize the then Grêmio player as one of his attackers.
In a statement to wowEgloff contested Cuca’s version, which, according to him, was recognized by the victim as one of his rapists in a case that happened in a hotel in Bern, Switzerland, and which led the coach to be sentenced to 15 years in prison by the Justice of the European country. The crime prescribed in 2004 and he never served his sentence.
“Alexi Stival’s (Cuca) statement is false. The girl recognized him as one of the rapists. He was convicted of sexual relations with a minor,” said the lawyer.
In his first interview as coach of Corinthians, Cuca stated three times that the victim would not have recognized him as one of his aggressors. The others involved in the sex scandal were Eduardo Hamester, Henrique Etges and Fernando Castoldi, all Grêmio athletes at the time.
“Isn’t the victim’s word the most important thing? She said: I didn’t know him, I didn’t see him, he wasn’t there. It was three times. The woman’s word was that Cuca wasn’t there. How can I be convicted? For what?”, claimed Cuca last week. “If I could not be in the room, I wouldn’t be. But I didn’t do anything, if anything happened. What is the woman’s word? That Cuca wasn’t there”, he added.
The lawyer also validated the news published by the newspaper Der Bundfrom Bern, in 1989. The publication pointed out that Cuca’s semen was found on the girl. According to Egloff, the exam was carried out by the Institute of Forensic Medicine at the University of Bern. “It is correct that Alexi Stival’s semen was found on the girl’s body,” he said.
In testimonies at the time, the victim narrated that he was forcibly held by the four Grêmio players, who remained in prison for 30 days. Fernando was the first to be released, as his participation in the act was not proven. In 1989, Cuca was sentenced to 15 months in prison and paid US$ 8,000.
The judgment was made in absentia, since he and the other gremistas involved in the case had already returned to Brazil after being released at the end of the instruction phase in the process. The process is under 110-year secrecy, protected by Swiss data protection law.
