Lawyer leaves Zambelli, and deputy seeks defense for TSE – 07/07/2023 – Politics

Lawyer Karina Kufa, who represents former president Jair Bolsonaro (PL) in part of his processes, left the defense of federal deputy Carla Zambelli (PL-SP).

In all, her office acted in more than 40 lawsuits filed against the parliamentarian, in addition to a smaller portion of about 20 lawsuits initiated by the deputy, covering the civil, electoral and criminal areas.

According to the lawyer, the departure of Zambelli’s defense was due to the “financial unfeasibility” of the client in view of the number of demands, which would have increased a lot since her office took over the defense.

Two of the actions calling for Zambelli’s ineligibility claim that she would be part of an “ecosystem of Bolsonarist disinformation”, which would act to “usurp issues of public debate”.

One of them was presented by the coalition of current president Lula (PT) and has dozens of targets. The action maintains that there would be a set of profiles on social networks acting for the acute propagation of misinformation against the PT candidacy, against the integrity of the electoral system and in favor of Bolsonaro’s candidacy.

Two other actions focus on attacks on the electoral system and the regularity of elections, in which, for example, a video from late November is cited in which she addressed generals, asking them not to accept the election result.

In the records, the defense pleaded, in general terms, that the requests for actions be considered invalid, questioning the arguments and evidence presented. They argue that Zambelli’s conduct did not characterize abuse of political or economic power or misuse of social communication media

Already in process at the STF (Federal Supreme Court) related to the episode in which Zambelli pursued, with a gun in hand, a man on the eve of the second round, who is in charge of the defense of the parliamentarian is the lawyer Daniel Leon Bialski.

In March, the Supreme Court opened an inquiry to investigate the deputy on suspicion of armed persecution. She had already been denounced by the PGR (Attorney General’s Office) at the end of January on charges of illegally carrying a weapon and illegal embarrassment with the use of a weapon.

She has maintained that she acted in self-defence at the time and that she was the victim of an assailant.

In the electoral field, in addition to the actions that may result in his impeachment and ineligibility, Zambelli is also the target of representations about irregular electoral propaganda, having been the target of condemnation in at least two of them during the month of May.

In one of these cases, a fine of R$10,000 was set in May, both for Zambelli and for senators Flávio Bolsonaro (PL-RJ) and Mara Gabrilli (PSD-SP) for disclosing disinformation that associated Lula with Celso’s death. Daniel, former mayor of Santo André (SP) murdered in 2002.

At the time, the deputy stated that there is a restriction on the “free debate of ideas” and that it cannot be accepted that “only the versions of the authorities are allowed to be propagated”.

In another action in which there has already been a decision, the court’s understanding was also that there was sharing of false content against the PT, due to a video in which Lula is accused of encouraging the use of drugs by children and adolescents and the phrase “does the L” is associated with crime and censorship on networks. In addition to Zambelli and Flávio, MPs Nikolas Ferreira (PL-MG) and Eduardo Bolsonaro (PL-SP) were convicted.

The third most voted federal deputy in the last elections, with 946 thousand votes, behind Nikolas and Guilherme Boulos (PSOL-SP), Zambelli had her social networks suspended by the TSE in the week following the second round.

In February, the president of the electoral court, Alexandre de Moraes, unblocked the profiles, but maintained a fine of BRL 20,000 in the case of publications “instigating or encouraging a military coup, violating Electoral Justice and the democratic State”.

Allied with Bolsonaro, Zambelli made posts encouraging coup acts after the elections, such as roadblocks that spread across the country after Lula’s victory at the polls.

In June, Moraes ordered the referral of the records of the process of blocking the Zambelli networks from the TSE to the STF, arguing that there was thematic relevance with the inquiries that are running in the court.
