Brasilia DF) – Law 14,717/2023 was published in the Official Gazette of the Union (DOU), last Wednesday (1), which provides that children and dependents of women victims of feminicide are entitled to a pension. The law was sanctioned by President Lula, with the text written by federal deputy Maria do Rosário (PT-RS).

The pension will be aimed at children under 18 and low-income, with a per capita family income equal to or less than a quarter of the minimum wage. Beneficiaries who are entitled will share the pension and may have access before the conclusion of the crime trial, in cases where there is evidence that the crime is femicide.

In cases where, after the conclusion of the trial, it is decided that no femicide occurred, payment will be suspended, without the need to return the amount received. Furthermore, the law prevents the benefit from being accumulated with other Social Security benefits.

The pension cannot be administered by the suspect of authorship or co-authorship of the crime. The crime of feminicide is provided for by law, described in art. 121 of the Penal Code.
