Justice prohibits flag with pole in stadiums – 06/22/2023 – Sport

After an appeal by the Public Prosecutor’s Office, the 1st Criminal Appeals Panel of the São Paulo Court revoked the release of flagpoles in stadiums in São Paulo. The information was disclosed on Thursday (22).
The poles had been authorized in July last year by the TJ-SP (São Paulo Court of Justice), on the grounds that this right was guaranteed by the Fan Statute. Artifacts have been banned from football fields in the state since 1996.

The release had been requested by the 6th Police Station for the Repression of Sports Tolerance Crimes. In response to this, prosecutor Regiane Vinche Zampar Guimarães Pereira argued that the police authority does not have the legitimacy to make such a request, as well as the Fan Statute.
The Public Prosecutor’s Office also claimed that the state legislation banning the flagpole is legitimate.
The decision to revoke the authorization was made by Judge José Eugênio do Amaral Souza Neto. He considered, according to the MP, that the federal and state public security forces need to reach a conclusion on the matter. “However, this police authority, this process and this judgment are not the right people and scope for solving the problem,” he added.
