Justice orders to release suspect of killing Palmeiras – 07/12/2023 – Daily life

Following the request of prosecutor Rogério Leão Zagallo, the Court of Justice of São Paulo issued this Wednesday afternoon (12) the revocation of the preventive detention of Flamengo player Leonardo Felipe Xavier Santiago, arrested on suspicion of having thrown a bottle in the direction of Gabriela Anelli Marchione, 23. The Palmeiras fan died after being hit in the neck during a disturbance around Allianz Parque, in the west zone of São Paulo, on Saturday (8).

The suspect, a resident of Rio de Janeiro, was arrested shortly after the fight. He was being held in a Provisional Detention Center in the capital.

The revocation was issued by Judge Marcela Raia de Sant’Anna, from the 5th Jury. In the decision, the magistrate says she agrees with the request of the Public Ministry since the accused’s testimony was different from that exposed by the delegate of the case, Cesar Saad.

“It so happens that, contrary to what was reported and stated by the Chief of Police, the accused did not confess to having thrown the bottle at the opposing team’s fans. who had ice cubes in her hands, which she threw in retaliation for rockets that the people of Palmeiras would have thrown at the Flamengo supporters”, highlighted the judge.

As in the prosecutor’s request, the judge also emphasized that the images recorded by other fans showed the moment when a bearded man threw the bottle, in addition to being physically different and wearing lighter clothes than the accused.

Marcela Raia de Sant’Anna also criticized the performance of the delegate in the case.

“Furthermore, given the deplorable, to say the least, attitude of the Chief of Police, who proved to be hasty and unprepared to conduct investigations, it is strictly necessary to send the case to the DHPP, a specialized body prepared to conduct investigations of this kind .”

Finally, with the release decision, the judge determined two precautionary measures for the accused: it prohibited him from leaving the district where he resides for more than eight days without judicial authorization and from changing residence without notifying the court.
