Justice of SP determines seizure of Arena do Grêmio – 06/15/2023 – Sport

The Court of Justice of São Paulo (TJSP) accepted a request for seizure of the Arena do Grêmio this Tuesday (13). The decision was published by Judge Adriana Cardoso dos Reis, from the 37th Civil Court.

Banco do Brasil, Santander and Banrisul, institutions that financed the work, collect debts of more than R$ 226 million left by Metha (formerly OAS). The attachment request was made by the banks in April.

The debt amount considers fines for late payments and is updated until April 2022. The banks are creditors of Arena Porto Alegrense, which manages the Gremista stadium. The company can still appeal.

The information was published by columnist Jocimar Farina, from GZH, and confirmed by Sheetwho had access to the case file.

The three banks went to court last year to collect the debt. The institutions financed the stadium works with R$ 210 million, but only R$ 66 million were paid.

The decision published by the Justice of São Paulo cites not only the stadium, but also the surface right, which allows construction or planting on someone else’s land.

In a note released to the press, Arena Porto Alegrense stated that the attachment is inherent to the process and aims to “ensure the execution of the debt filed by the creditors and allow the defenses presented by the debtors to be appreciated”.

The company added that the arena corresponds to 8% of the debt, and that it will question the decision on appeal. Check out the full note at the end of the text.

When contacted, Banco do Brasil and Banrisul told the Sheet who will not comment on the case. Santander did not comment until the publication of the report.

What is the attachment of assets?

The attachment of assets is a judicial instrument provided for in the Code of Civil Procedure, which allows the creditor to “hold” an asset and even expropriate it from the debtor. In practice, it serves as a guarantee that the payment of the debt will be made.

After the attachment, can Grêmio be without a stadium to play?

No. In an official note released by the club on the morning of this Wednesday (14), Grêmio announced that it will continue to act as the host of the games in the arena even after the seizure. Tricolor reinforced that “it has the right to receive the arena free of charge”.

Grêmio still owns the space where the ruins of the Estádio Olímpico are located, where they played games before 2013 – the Arena was inaugurated in December 2012. The club tried to buy the right to manage the arena, a plan that ran into legal proceedings against to Metha (formerly OAS).

The construction company would not have concluded works around the stadium at the time of its construction, foreseen in agreement with the City Hall of Porto Alegre. The team has not yet delivered the land at Olímpico to Metha.

Is Grêmio involved in the process?

No. It is important to emphasize that the club from Rio Grande do Sul is not mentioned in the process, but Arena Porto Alegrense, the company that manages the stadium. The team said it is following the case with the help of club and external lawyers.
