Judicial branch that assists Yanomamis in RR gains reinforcement – 02/17/2023 – Panel

The 4th Federal Court of the Judiciary Section of Roraima, received a new auxiliary judge, after the Corregedoria Nacional de Justiça, linked to the CNJ (National Council of Justice), asked for clarification on the performance of the unit, which deals with issues related to the Yanomami in the state. It is up to her to combat illegal activities in the Indigenous Land, such as mining and invasions, for example.

Substitute federal judge Rodrigo Meireles Ortiz, who has been in charge since February 7 with full dedication, will be joined by Gabriel Augusto Faria dos Santos, who will combine his activities with the office he exercises in the 3rd Court of Roraima.

The 4th Court is the only one specialized in criminal matters and receives the second largest volume of cases compared to all the criminal courts of the TRF-1 (Federal Regional Court of the 1st Region). Until last year, the court included 11 states, including Minas Gerais, Bahia, Amazonas and the Federal District.

In 2022, the Judiciary section of Roraima received 2,311 cases with only one judge to analyze them. It was only behind the 7th Vara in Rondônia, with 2,740; the average on the TRF-1 is 1,196.

“From the numbers, it appears that there is an intense movement of processes, as it is a court located on the border with Venezuela and Guyana, in addition to the indigenous peoples who inhabit the territory of Roraima”, highlights the report sent to the CNJ.

Despite the shortage of human resources, the CNJ correction pointed out that the work flow meets the demand. “This is because, considering the period from 01/01/2021 to 02/07/2023, even with only one full magistrate, the unit reached the highest number of final sentences/decisions in relation to all the Criminal Courts of the 1st Region” , says federal judge Néviton Guedes, regional inspector of the Federal Justice of the 1st Region. There were 1,730 decisions, when the average for the region is 1,319.

The information was requested by the national justice inspector, Minister Luís Felipe Salomão, after the humanitarian crisis of the Yanomami gained national prominence.

In his dispatch, the minister cites not-recent official letters that reported the high distribution of cases, “causing a disproportionate increase in the workload of the entire judicial service, which, in turn, directly impacts the quality and efficiency of judicial provision in the Judiciary Section of Roraima”.

The magistrate also highlights that Judge Bruno Hermes Leal, the only one on the 4th Rod, had been assigned as an assistant at the STJ (Superior Court of Justice) in February 2023. Salomão sought to understand how the situation had turned out. The TRF-1 clarified that the act of assignment of the judge to the STJ was signed on the same day that Rodrigo Meireles Ortiz was appointed to replace him, and the unit was not left unattended at any time.
