Judges debate new rules on weapons in the Lula government – 01/19/2023 – Frederico Vasconcelos

The AMB (Association of Brazilian Magistrates) promotes this Thursday (19) at 5 pm online debate on Decree 11.366/2023, by the Luiz Inácio Lula da Silva government, which changes the rules for acquiring firearms registration.

In February 2021, four decrees signed by then-president Jair Bolsonaro made access to firearms more flexible.

The acts were published on the eve of the Carnival holiday. At the time, the PSB announced that the measure was a “setback” in the area of ​​fundamental rights and that the decrees would “improvely” facilitate access to weapons and ammunition.

In a note, the Planalto Palace informed that “the package of amendments to the firearms decrees comprises a set of measures that, ultimately, aim to materialize the right that persons authorized by law have to acquire and carry firearms and to the exercise of the activity of collector, shooter and hunter, in the spaces and limits permitted by law”.

At the time, Apamagis (Associação Paulista de Magistrates) reported that the change allowed the judiciary to “remove restrictions considered undue to the class”.

Based on Bolsonaro’s decrees, Apamagis signed an agreement with Glock do Brasil so that judges and dependents could purchase pistols and ammunition at special discounts. The association also entered into an agreement with the CTT (Tactical Training Center), which offers specialized training courses.

Persons authorized by Law 10.826/2003 could purchase up to six permitted weapons. Previously there were four. This limit could rise to eight in the cases of careers that depend on the possession and carrying of weapons for the exercise of their functions, such as the Armed Forces, police and members of the Judiciary and the Public Prosecutor’s Office.

“After several years of struggle, Apamagis managed to make feasible, for the first time, the agreement for the sale of weapons to associate magistrates”, said Edison Brandão, on the occasion.

The AMB informs that it will seek to act together with the representatives appointed by the CNJ (National Council of Justice) in the Working Group created to discuss the new regulation of Law 10.826/2003.

Judge Edison Brandão is advisor to the presidency of Apamagis (Paulista Association of Magistrates) and director of security at AMB.

Judge Rafael Pagnon Cunha has been invited to teach shooting courses for judges. Last September, he was one of the shooting course instructors for 21 judges in Paraná, who received guidance on weapons and combat APH (pre-hospital care).

Delegate Luciano Soares Leiro was vice-president of ADPF for four years and regional director of ADPF in the Federal District for 11 years. Bachelor of Law, with specialization in criminal sciences, he was an agent of the Civil Police of the Federal District. He joined the Federal Police as an agent in 2003.

In 2008, he took over as a federal delegate. He was responsible for the Nucleus for the Repression of Crimes against the Administration of the Federal Police Superintendence in Brasília and coordinator of the STF’s Inquiry Group. He was a professor at the National Police Academy.

Leiro was a candidate for federal deputy in 2018 for the PPS. He was not elected.
