Judge says Mamãe Falei harassed Ukrainians at war – 08/18/2023 – Mônica Bergamo

The Justice of São Paulo denied the claim for compensation that former deputy Arthur do Val charged from federal deputy Guilherme Boulos (PSOL). Mamãe Falai, as he is known, accused the psolist of making false statements for having said that Val was “revoked for harassing a woman at war in Ukraine”.

In March of last year, sexist audios sent by Mamãe Falai during her trip to Ukraine to follow the conflict in the country were made public. In the messages, he said that Ukrainian women were “easy” to pick up because they were poor. The statements led Do Val to have his mandate revoked in May.

For Judge Marcela Filus Coelho, from the 1st Special Civil Court of the São Paulo Court of Justice, the audios make it “clear that he in fact disrespected women”.

“The plaintiff [do Val]when reporting that he ‘stuck’ in the ‘easy’ and ‘poor’ mines, reveals that he was there to harass and belittle anyone facing a war”, she says in the decision.

The magistrate adds that, by using these words, the former deputy had the intention of objectifying and belittling Ukrainian women. It is up to appeal.

The judge also denied the request for a public retraction and exclusion of Boulos’ post on the subject. According to her, the federal deputy did not accuse Mom I spoke of sexual harassment, but used the term harassment in the sense of “impertinent insistence, a fact that occurred”.

The judge also points out that the opinion that supported the impeachment of the former deputy uses as one of the main grounds the content of the audios in which he talks about Ukrainian refugees. “This time, it is noted that the defendant [Boulos] did not lie, did not commit an illicit act”, he says.

The court also cleared the psolist for saying that Mama Falai went to Ukraine with public money. Although there is no evidence that the expenses for tickets and stays were paid by the treasury, the magistrate states that there is also “no evidence that they were not”.

“Even if the defendant’s assertion is considered inadequate or inopportune [Boulos]questions about the correct use of public money are common situations for those who hold positions such as deputy”, justifies the judge.

“It should be noted, moreover, that the subject was only superficially alluded to. The author was not charged with committing a specific act; rather, there was a generic manifestation, incapable of constituting a false accusation of a criminal or administrative infraction”, continues she.

In the lawsuit, do Val also claimed that Boulos made untrue statements about the MBL (Movimento Brasil Livre). For the magistrate, however, the former deputy “has no legitimacy to defend the rights of others in his own name”.
