Judge offers coffee and coat to prisoner during custody hearing and video goes viral

A video recorded during a custody hearing held this Wednesday (10) went viral on the internet showing a judge offering coffee and a coat to a man arrested for drug trafficking and saying that she would not continue driving with the boy “ shivering from the cold.” Preliminary information indicates that the session would have been led by a judge from Roraima called Lana Leitão Martins.

According to dialogue during the recording, the prisoner’s name is Luan Gomes and he is 20 years old. The crime that was allegedly committed by him is not mentioned, but sources claim that he was arrested with several quantities of drugs by the Integrated Force to Combat Organized Crime (Ficco) of Roraima.

“Are you cold?” asks the judge. With the boy’s affirmative response, she continues: “We have to take off his handcuffs, because now the hearing cannot take place with the defendant cold.”

At this point, the judge asks again if the custodian is cold and asks that the air conditioning in the room be turned off. She then asks someone in the room to get the custodian a coffee and find him a coat to wear. A man offers him his jacket and puts it on while the boy consumes the hot drink.

“Ready. When you stop shaking [de frio] We will continue the hearing”, said the judge, then asked if his condition had improved. The boy then nods positively.

Although the video does not make clear the source of the recording, the report found that the hearing was held in a new building attached to the Duty and Custody Hearing Center (Nupac) of the Court of Justice of Roraima (TJ-RR), in Boa Vista .

The session would have been led by judge Lana Leitão Martins, appointed as director of the Criminal Forum. In December last year, during the inauguration of the Nupac building, the judge said that “criminal justice is a justice system that guarantees human rights, and the [audiência de] Custody is the gateway to these rights. Therefore, welcoming these people is of vital importance”, said the judge on the website of the National Council of Justice (CNJ).

A People’s Gazette contacted the TJ-RR, which simply stated that “depositions must be conducted confidentially and in conditions suitable for the custodian. Therefore, we cannot disclose information about what happened.”

“As mentioned in an excerpt from the CNJ resolution, custody hearings must take place in appropriate conditions, respecting the principles of human rights,” he stated.

Also according to the TJ-RR, the resolution also establishes that “the person in custody must not be or remain handcuffed during the hearing, unless there is resistance, risk of escape or danger to the physical integrity of the person or third parties”.
