Judge Alaíde Maria de Paula, from the Fourth Civil Court and the Public Treasury of Macapá, accepted the action taken by Santos Futebol Clube, reconsidered the previous decision and removed the entire board of directors of the Amapaense Football Federation (FAF), chaired by state deputy Roberto Góes (União Brazil), including the members of the entity’s fiscal council.
He ordered the president of the Sports Justice Court (TJD) to appoint, within 48 hours, a commission made up of three members of the court to respond to the federation. Roberto Góes, who in addition to being president of the FAF holds a vice-presidency at the Brazilian Football Confederation (CBF), has already announced that he will appeal to the Court of Justice of Amapá (Tjap).
Alaíde de Paula’s decision was taken in the judgment of a request for reconsideration presented by the affiliated Santos Futebol Clube, which denounces the occurrence of irregularities in the election of the federation’s board, held two years ago.
The club submitted a request for reconsideration of the decision that rejected the request for urgent provisional protection. He argued that the decision did not analyze the illegalities committed by the current administration of the Amapá Football Federation, reaffirming his arguments in the sense that the current president of the entity is serving his fifth term and that the notice calling for the election was published only once and without the disclosure of the electoral college. It also accuses that an unaffiliated club or club without the right to vote participated in the election.
According to the judge, there are serious and strong indications that the plaintiff (Santos) – as an entity associated with the FAF – had his rights to participate in the association’s decision-making offended.
“I also note that there is a risk to the useful outcome of the process, since the processing of this event may last longer than the current mandate of the FAF board. Thus, the author runs the risk – if provisional protection is not granted – of the author club petitioning in the new electoral process (as a candidate or even voter) conducted by a board that was not legitimately elected”, wrote and judge in part of the decision.
Alaíde Maria de Paula appointed the president of the Court of Sports Justice, Arthur Silva Lobo, as intervenor until the conclusion of the electoral process for the new board of directors of the Amapaense Football Federation.
