Judge grants injunction and suspends session of the Oiapoque City Council that would decide on the impeachment of Mayor Breno – News of Brazil

Judge Robson Timóteo Damasceno, on duty at the Oiapoque Center, ordered the suspension of the session of the Oiapoque City Council, scheduled for this Friday (5), when councilors were supposed to decide on the revocation of the mandate of the dismissed mayor Breno Lima de Almeida . The suspension will remain until a decision is made by the Natural Court, to whom the files will be sent by the on-duty as soon as the Judiciary recess ends. The chamber must also send information within ten days.
Robson Timóteo decided to suspend the writ of mandamus filed by the defense of mayor Breno Almeida, who alleges irregularities in the administrative process, such as lack of production of evidence, failure to provide videos with the statements given or full transcription, lack of analysis of defensive arguments at the time of the final report, as well as vested interests involved in such a trial, including the alleged buying of votes from parliamentarians, in order to influence the outcome of the trial.
The judge granted the injunction only to suspend the session, failing to analyze the mayor’s other defense requests, in deference to the principle of separation of Powers and the absence of contradiction. The chamber’s legal sector denies the statements made by the dismissed mayor’s lawyer and ensures that all requested documents have been forwarded.
Investigated, arrested and removed
In October last year, the Federal Regional Court of the 1st Region (TRF1) ordered the removal of the mayor of Oiapoque, Breno Lima de Almeida, elected by the PRTB, for a period of 180 days. Breno was one of the targets of Operation Crateras launched by the Federal Police, which investigates the embezzlement of R$1.5 million in federal funds from the Calha Norte program.
The person who took over the mayor’s office was vice-mayor Euclimar Fontineles Lima, elected by PROS, who has broken ties with Breno since the beginning of their mandate. Euclimar is 48 years old and was a councilor in the municipality. In addition to being removed by the Federal Court, Mayor Breno is the target of an investigation by the Oiapoque City Council and is facing several processes in the state court.
Breno Almeida, whose father, Miguel do Posto, was also mayor of Oiapoque, came under the radar of investigations when the Public Ministry of Amapá (MP-AP) took action against him to prohibit the continued removal of trees in the central median of Avenida Barão do Rio Branco, in the central neighborhood of the municipality, which were being removed to carry out a project to revitalize the street. The action was filed against Breno Almeida and the company Uninorte Empreendimentos Eireli-EPP, owned by Josivaldo Fernandes da Silva, target of the operation and arrested in a previous operation launched in Ferreira Gomes.
The case was then passed to the Federal Public Ministry (MPF) as it involved resources from the federal government’s Calha Norte Program. The court order to launch Operation Craters was issued by the Federal Regional Court of the 1st Region, which ordered the removal from office of the mayor of Oiapoque, the municipal deputy attorney, municipal secretaries and other employees. The investigation began just over a year ago and found alleged irregularities in agreements signed between the municipality of Oiapoque and the construction company Uninorte, whose federal funds came from the Calha Norte Program. The agreements were fully paid in the amount of approximately R$1.5 million and the works were not delivered.
