Judge asks for respect for alleged killer and gives prison sentence to victim’s mother

This Wednesday (18), social media went viral with an excerpt from a hearing in which the judge of the 12th Criminal Court of Cuiabá, Wladymir Perri, gave Sylvia Miriam Tolentino de Oliveira an arrest sentence during the trial of the suspect of murdering the her son. The hearing took place on September 29th.

Sylvia was giving a statement about the death of her son, Cleowerton Oliveira Barbosa, who was murdered on September 10, 2016 with at least 10 gunshots.

At the beginning of her testimony, asked about the presence of the person accused of the crime in the same environment, Sylvia said that she didn’t care because, for her, the accused “is nobody”.

Immediately, judge Wladymir Perri asked for respect for the suspect and more “emotional intelligence” from the victim’s mother.

Sylvia rebutted the magistrate and said she knew what was happening. Due to the persistence of the judge’s position, the prosecutor in the case tried to intervene.

“My God, I can’t believe what’s happening at this hearing. The victim’s mother is speaking out… it’s very difficult to control […] He is a grieving victim”, said prosecutor Marcelle Rodrigues da Costa.

Exalted, the judge said that the prosecutor wouldn’t stop talking and closed the hearing. At this moment, Sylvia got up nervously, knocked on the table, threw away a plastic cup that she had in her hand and approached the defendant.

Sylvia said that the accused “escaped the justice of men” but would not escape divine justice. That was when the judge ordered the arrest of the victim’s mother.

“In the minutes of the hearing, the judge said that the woman, when she threw the glass, damaged public property, breaking the drinking fountain. But how does a plastic cup break a water fountain? Furthermore, the minutes also stated that she cursed the judge, but this was not proven either,” the prosecutor told the press.

According to G1, after receiving the arrest order, Sylvia remained in the Forum for another four hours because the judge would only have released the minutes into the system at 8 pm. The woman was then taken to give a statement at the police station.

According to prosecutor Marcelle Rodrigues, the police chief did not prosecute due to lack of evidence.

“The magistrate, in an evident abuse of authority, demonstrated that he is unprepared to welcome victims and families of victims of serious human rights violations, moving in a direction contrary to the institutional policy of the Judiciary”, declared the prosecutor after drafting the habeas corpus by Sylvia.

When contacted by G1, the judge informed that the facts are being investigated by his own determination and that he would have forwarded the images of the hearing to the state’s General Inspectorate of Justice and to the National Council of Justice.

Wanted by Gazeta do Povo, the Internal Affairs Department did not respond until the closing of this article. The report also sought out the section of the Brazilian Bar Association (OAB) in Mato Grosso, but received no response.

The newspaper remains open for any comments from the OAB and Internal Affairs regarding the case.
