INSS (National Social Security Institute) retirees and pensioners who won a lawsuit against the agency will receive R$ 1.37 billion in arrears this month. The values were released by the CJF (Council of Federal Justice) this Tuesday (21).

The money will be used to settle INSS debts in court with 84,533 beneficiaries, who won 66,480 cases of up to 60 minimum wages against the institute, called RPVs (Small Value Requests).

In all, R$ 1.68 billion were released to settle government debts with 144,984 beneficiaries in 117,914 processes. The total amount includes payments to INSS beneficiaries and civil servants.

In order to receive it in March, the retiree must have won an action that became final, that is, without any possibility of appeal from the INSS, and whose payment order from the judge was issued in February.

The payment date, however, will depend on the schedule of each TRF (Federal Regional Court), which is responsible for transferring these amounts to those who won the shares in the regions served by them.

In general, the processing of amounts takes ten days and begins to be done automatically, right after the release of the money by the CJF. This stage is the opening of accounts at Banco do Brasil and Caixa Econômica Federal.

To find out when you will receive it and if the action has already been released by the judge, citizens can consult the website of the TRF in their region. In São Paulo and Mato Grosso do Sul, the check is done through the TRF-3 website (Regional Court of the 3rd Region): trf3.jus.br. The court’s prediction is that the payment will be released next week.

This year’s RPVs are capped at R$78,120 this year, with the new minimum wage at R$1,302. As of May, when there should be a new readjustment of the minimum to R$ 1,320, the value should change to R$ 79.2 thousand.

How to consult the arrears of the INSS?

The query is made on the court’s website by informing the insured person’s CPF or lawyer’s OAB number. It is also possible to make the conference through the process number.

To find out if you are going to receive this batch, you must observe the month that appears in the “TRF protocol date” field. In March, policyholders whose arrears were cleared by the judge in February are received in March. After payment, the information “total payment to the court” will appear.

WHO HAS THE RIGHT?

Insured persons who sued the INSS and won the action, and whose date of the judge’s payment order is February. It is necessary that the process be of up to 60 minimum wages, as arrears with higher amounts become precatorios, which have a different payment system, with release in only one batch per year.

The RPVs to be paid refer to the concession or review of:

  • Retirement
  • death benefit
  • sick pay
  • BPC (Continued Provision Benefit)
