Did you complete the 2023 Income Tax declaration and will you have to pay an amount to the government? Know that part of this tribute can be reversed for donation, made in the statement itself. The deadline to donate is May 31, the final date for reporting to the Federal Revenue Service.

The annual donation limit is 6%. Those who did not make donations in 2022 manage to allocate up to 3% of the tax due to assistance funds for the elderly and another 3% to funds for assistance to children and adolescents. If you made a donation in 2022, this amount will be added to that of 2023 until the limit is reached.

The donation can only be made to those who deliver the complete model of the declaration. You will need to generate a Darf (Federal Revenue Collection Document), to be paid by May 31. The rule applies both to those who have tax to pay and to refund, that is, even those who will receive refund will have to generate Darf and make the payment.

The Revenue warns that the payment of the guide until the date is essential, under penalty of falling into fine mesh. If you don’t pay, you’ll have to rectify the statement and withdraw the donation made, as it works as a deduction in which you get back everything you paid.

How does this donation work?

Donating directly on the declaration allows up to 3% of the tax to be paid to be sent to special funds for the ECA (Statute for Children and Adolescents) or for special funds for the elderly. It is allowed to donate to both, but the limit is still 3% for each.

I have tax refund. Can I donate too?

Yes, the limits are the same and the amount will be added to the amount that will be refunded. The taxpayer will pay the Darf and, in the refund, will receive back the amount donated corrected by the basic interest rate of the economy, the Selic.

Can I donate to an organization I know?

It is not allowed to choose a specific entity in the case of donation directly from the declaration. The transfer of this format is intended for a national, state or municipal fund. The donation to an entity known by the taxpayer can only be made in the calendar year, that is, in this case, it could only have been made in 2022.

Can the donation only be made to a single type of fund?

No, you can allocate to more than one fund (national, state or municipal), either in the case of ECA funds or funds for the elderly.

What are the rules?

How do I pay this donation?

For every fund you donate, a Darf must be issued. So if you donate to four institutions, you need to pay four Darfs, one for each entity. If you still have tax to pay from the IR, you will still need to pay the Darfs referring to the IR.

What is the deadline to donate?

As long as Darf is not paid, the declaration will remain pending, but will not prevent shipment. As soon as the Revenue is notified of the payment, this pendency will be removed from the declaration.

In this case, the declaration will remain pending and the taxpayer will have to rectify it, excluding the donation that was not paid. After rectification, the statement will be without this pendency.

Where to declare the donation in the Income Tax?

  1. On the computer, in the menu on the left side, go to the Declaration Sheets item and click on Donations directly in the declaration. Already in the My Income Tax application, go to the Payments item and click Donations directly on the statement
  2. Choose whether you want to donate to Special Funds for Children and Teens, or Special Funds for Seniors
  3. After selecting, click on New which is the first button in the lower right corner
  4. Choose the type of fund to which you will allocate part of the tax (national, state or municipal). The CNPJ of the entity will be automatically generated by the Federal Revenue program
  5. The program will automatically calculate the amount available for donation. Enter how much you want to donate, respecting the limit
  6. When you finish the declaration, you must print the Darf. In the main menu, go to the Print item and click on the Darf you chose: Donations Directly on the Declaration – ECA or Donations Directly on the Declaration – Elderly Person. If you have donated to two or more entities, you will have to print a Darf for each, remembering that for each entity, you must print a Darf
  7. If you have tax to pay, you will also need to print another Darf or Darfs. In the same item Print, you will in Darf of the IRPF

I donated in 2022 as well. How do I declare?

Donations in 2022 must be declared elsewhere. Amounts or goods donated in the calendar year will be added to what is transferred in 2023 to reach the limit of up to 6% of the tax to be donated.

  1. On the computer, in the menu on the left side, go to the Declaration Sheets item and click on Donations made. Already in the My Income Tax application, go to the Payments item and click Donations
  2. Click on New, which is the first button in the bottom right corner
  3. Identify the collection code: 40 (Donations following the Child and Adolescent Statute), 41 (Incentive to culture), 42 (Incentive to audiovisual activity), 43 (Incentive to sport), 44 (Donations in 2002 – Funds Controlled by Councils for the Elderly), 80 (Donations in kind), 81 (Donations of goods and rights) and 99 (Others).
  4. Put the CNPJ and name of the fund or project that received the donation, and the amount paid. Check that the data is correct and click OK
  5. If you have tax to pay, you will need to print the Darf. In the main menu on the left, go to the item Print and Darf do IRPF
