INSS: Justice releases BRL 1.9 billion to pay arrears – 06/21/2023 – Market

Retirees from the INSS (National Social Security Institute) who won actions to grant or review the benefit in court may be entitled to receive the amounts due this month. The CJF (Conselho da Justiça Federal) released R$ 1.9 billion to pay the arrears.

In all, 118,634 beneficiaries will be covered who won 92,133 cases against the institute. The amount will settle the so-called RPVs (Small Value Requests), which are delayed by up to 60 minimum wages.

The total amount of RPVs reaches R$ 2.2 billion, as it also includes other small-value requests. Among the lawsuits are civil servants who defeated the federal government in court and are entitled to receive the money, provided there is a payment order from the judge. In all, 194,011 citizens who won 156,097 cases will benefit.

In order to receive this lot in June, the process must have reached the end of the process, with no possibility of INSS appeal. In addition, the payment order must have been issued by the judge sometime in the month of May.

The money falls into the insured’s account after the release made by the TRF (Federal Regional Court). The courts open accounts at Banco do Brasil or Caixa Econômica Federal in the name of the retiree or his lawyer to make the deposit. This account opening step is called processing.

The query to find out if you will receive this month is done on the TRF website in your region. In São Paulo and Mato Grosso do Sul, for example, citizens can consult the TRF-3 (Regional Court of the 3rd Region) website: trf3.jus.br.

This year’s RPVs have two caps. Until April 30, they are worth R$ 78,120, with a minimum wage of R$ 1,302 in force in the country from January 1 until then. As of May 1, with the readjustment of the minimum published by President Luiz Inácio Lula da Silva, which rose to R$ 1,320, the value changes to R$ 79.2 thousand.

In the consultation, the insured can see the amount that will be deposited by Justice. Just go to a field that reads “Amount entered in the proposal”. This amount, however, may have corrections according to the date of payment.

HOW DO I ASK TO FIND OUT IF I WILL RECEIVE THE RPV?

The query is made on the website of the court in the region where the retiree or pensioner opened the process, informing the insured person’s CPF or lawyer’s OAB number. It is also possible to make the conference through the process number.

To find out if you are going to receive this batch, you must observe the month that appears in the “TRF protocol date” field. In May, policyholders whose arrears were released by the judge in April are received in May. After payment, the information “total payment to the court” will appear.

RPV OR PRECATORY?

When consulting your arrears on the website of the court in your region, you can find out whether you will receive RPV, which is paid within two months after the judge releases the amounts, or by precatório, released only once a year by the CJF.

For those who will receive arrears of up to 60 minimum wages, the “Procedure” field will read “RPV”. If the value is greater, the same field will contain “PRC”.

WHO HAS THE RIGHT TO RECEIVE INSS DELAYS?

Insured persons who sued the INSS and won the action, with no possibility of appeal, are entitled to arrears. In addition, the money only comes out after the judge’s order to pay the amount. It is necessary that the process be of up to 60 minimum wages, as arrears with higher amounts become precatorios, which have a different payment system, with release in only one batch per year.
