Governor Clécio Luís decreed, for reasons of public interest, the intervention in the Decentralized Education Execution Unit (UDE), and determines the immediate removal of the current board, including regarding its functional responsibilities.
He reports in the intervention decree that the state of Amapá responds subsidiarily in thousands to the labor actions filed against UDE and Caixas Escolares, and that there was a statutory change aimed at extending the period of stability for members of the UDE board without such change being previously submitted for consideration by the Department of Education and, going further, that such a change could only have been resolved in an Extraordinary General Assembly specifically for that purpose – a null act, therefore.
Clécio also considered that there was a flagrant violation of the statutory rule that establishes that the hiring of personnel and acquisition of material must be in line with state, federal and other agreements.
He considered that there is strong evidence of an undue increase in the salary sheet of the Decentralized Education Execution Unit (UDE). During the directors’ absence, the employment relationship and remuneration of the members are guaranteed.
To compose the Intervention Committee, the governor appointed Edilene Santos Abreu (president), Ana Luísa Feio Bezerra, Viviane Linhares Carmezim Perdigão Gomes and Jackson Sampaio de Souza. The deadline for carrying out the Committee’s work is 180 days, extendable for the same period, as many times as necessary to complete the extraordinary intervention work.
The UDE was created on February 6, 2007, by the State Department of Education as a civil association with a legal nature under private law, exclusively to centralize the transfers of personnel resources from Caixas Escolares, as well as to gather and manage this demand for personnel – thus being subject to the final control of the Administration. Although in the strict form of a civil association with a legal nature under private law, it is an entity that is not part of the Public Administration and does not make up the public budget, it is a private entity that, since its creation, has had its funding and assets formed exclusively by the public treasury. , funds allocated to education, with the statutory purpose of developing priority initiatives of the Department of Education.
