The minister declared the decision of the Federal Justice null and void and asked the PGR to analyze the police report
Brasilia DF) – Minister Gilmar Mendes, of the Federal Supreme Court (STF), ordered the unfiling of an investigation into omission and alleged criminal conduct by public agents during the Covid-19 pandemic. Gilmar Mendes declared null and void the decision of the Federal Court that decreed “partial archiving” of the action.
Thus, considering the entire report presented by the Federal Police, it determined that the investigation records be opened to the Attorney General of the Republic.
With the unfiling, the PGR analyzes again whether there is evidence of criminal conduct against the former President of the Republic, Jair Bolsonaro (PL); the former Minister of Health, Eduardo Pazzuelo; the former secretary of Work Management and Health Education, Mayra Pinheiro; Colonel Antônio Élcio Franco; the former Secretary of Communication for the Presidency, Fabio Wajngarten and Mauro Luiz Ribeiro, president of the Federal Council of Medicine, at the time of the pandemic.
The confidential decision says that the partial nullity was handed down “by incompetent authority” and it is stopped because there are agents with prerogatives in investigations.
Those cited are investigated for prevarication, epidemic resulting in death, irregular use of public funds and false reporting of crime.
After denunciations and indications raised by the CPI of Covid, the Public Prosecutor Marcia Brandão Zollinger manifested herself for the partial archiving of the investigations because she understood that there was no evidence of a crime. Justice accepted understanding, now overthrown by Gilmar Mendes with the request for reassessment.
