Minister Gilmar Mendes, of the STF (Federal Supreme Court), annulled a decision by the Federal Court in the Federal District that shelved part of an investigation into suspected irregularities and omissions committed by former President Jair Bolsonaro (PL) and members of his management. during the Covid-19 pandemic.
In the decision, which is secret from the Court, Gilmar states that the shelving of the investigations could not have been decided by the Federal Court, but by the Supreme Court, since part of the targets had special jurisdiction.
The investigation targets, in addition to Bolsonaro, the former Minister of Health and federal deputy Eduardo Pazuello (PL-RJ), the former number two of Health Colonel Elcio Franco, the former Secretary of Communication of the Presidency Fabio Wajngarten and Mayra Pinheiro , the “chloroquine captain”, former secretary of the Ministry of Health.
The investigation deals with suspected crimes such as epidemics resulting in death, irregular use of public funds, prevarication and false reporting of crimes.
Gilmar determined that the Attorney General of the Republic, Augusto Aras, assess whether or not there are signs of crimes in the conduct of those being investigated.
The investigation was opened from the findings made by the Covid CPI in the Senate.
A Federal prosecutor, Marcia Brandão Zollinger, had asked the Justice last year to partially close the case because she understood that there were no elements against Pazuello, Elcio and Mayra. As is customary, the request of the Public Prosecutor’s Office was accepted.
