Minister Gilmar Mendes, of the Federal Supreme Court, vetoed this Monday (7), the creation of new vacancies in Medicine courses in private institutions, if they do not meet the requirements of the Law of More Doctors. The decision is provisional and still needs to be endorsed by the plenary of the STF.
With the decision of Gilmar Mendes, the Minister of Education, Camilo Santana informed, this Tuesday (8), that “judicial decision is fulfilled” and the portfolio will adapt to the new requirements. “The MEC will launch a new preliminary notice and will comply with the judicial decisions of the processes that are already in progress in the Judiciary, complying with the decision of the STF. What has already been approved is approved, ”he said.
In April of this year, the MEC published an ordinance that authorizes the opening of new places in medical courses in regions of the country where there is a shortage of physicians. According to the text, the opening of vacancies in medicine should be done through public calls that prioritize regions with a lower ratio of vacancies and physicians per inhabitant.
Mendes understood that the requirement is constitutional and that it must be complied with, something that was contested by representatives of educational institutions. In the decision, the minister also reinforced that new medical courses “already installed” by “judicial decisions that waived the public call and imposed the analysis of the procedure for opening the medical course or expanding vacancies in existing courses” will not be affected.
