Gilmar Mendes orders the release of 85 semi-open prey to open vacancies

Minister Gilmar Mendes, of the Federal Supreme Court (STF), decided, this Monday, the 16th, to grant freedom to 85 women imprisoned in a semi-open regime – who returned to prison only at night – at the Colmeia Penitentiary, in the Federal District. The decision meets an emergency request from the Public Defender’s Office.
The measure aims to reduce the number of detainees and make room for women suspected of participating in acts of vandalism or for being camped out in front of the Headquarters in Brasília.
The Secretariat of Penitentiary Administration of the Federal District (Seape-DF) issued an alert, last Friday (13), for overcrowding in the penitentiaries of the federal capital. In the decision, the minister recognizes the “exceptional situation” that overcrowded the penitentiary.
“Therefore, the partial granting of the incidental request made by the Public Defender’s Office of the Federal District is justified, consisting of the replacement of the collection in the penal establishment by the granting of early departure with electronic monitoring for a period of 90 (ninety) days”, stated Gilmar Mendes .
According to the minister, the impact of the illegal conduct of those accused of the acts “also imposed negative externalities on the inmates who had their rights restricted due to the entry of 513 new women”. Gilmar Mendes also determined that “given the urgency of the measure” his decision has “force of mandate and office”, that is, it must be fulfilled immediately.
