Minister Luiz Fux, of the Federal Supreme Court, said, this Friday (12), that federal deputies and senators should stop suing the Court on issues that fall to Congress. National legislate and deal with the electoral burden of their proposals. He criticized what he called the “judicialization of politics”. The statements were given during the Law in Industry seminar, held by Firjan in downtown Rio.

“In the first place, Parliament must assume the social cost. What cannot happen is this judicialization that has taken place. They all go to the Federal Supreme Court because they do not want to pay the social cost of a decision that does not please the people” said the minister.

Fux reinforced that, despite the Supreme Court ministers not being elected, the Judiciary must have the respect of the population so that attacks like the one on January 8, in Praça dos Três Poderes, do not happen again.

The minister also criticized the judicialization of legislative proposals, such as the forest code, in which the STF assumed the role of a constitutional court to avoid legal uncertainty. “There are issues that the judiciary does not have legal competence for. How about the forestry code, for example, we who are going to say what is right? We don’t even have training for that. nor social issues.”, he said.
