The minister of the Federal Supreme Court (STF) Luiz Fux decided this Monday (4) to open an investigation against federal deputy André Janones (Avante-MG) to investigate allegations of “cracks” in his office. The magistrate responded to a request from the Attorney General’s Office (PGR). Fux ordered the Federal Police to take the necessary steps for investigation within 60 days.

In audios attributed to the parliamentarian, he demands the return of part of the salaries of his office employees at the time to help him cover election campaign expenses. The allegations were made public last week by Metropolis portal. “Having affirmed the preliminary jurisdiction of this Supreme Court, it appears that the requests for diligence formulated by the Federal Public Ministry are based on the evidence of alleged criminal practice revealed to date”, wrote the minister.

“In this context, the suspicion of criminal practice involving the holder of forum prerogative before the Federal Supreme Court demands clarification regarding the possible typicality, materiality and authorship of the alleged facts”, he added. Fux highlighted that the “initiation of an investigation does not convey the formulation of a judgment regarding the origin or unfoundedness of the evidence of authorship or materiality, constituting a merely formal act”.

PGR request

The request for investigation against Janones was signed by the Deputy Attorney General of the Republic, Ana Borges Coêlho. For her, there is “sufficient suggestive evidence” of crimes such as criminal association, embezzlement and concussion. In the document, Coêlho highlighted that the investigation is necessary to clarify whether the parliamentarian “associated himself” with his advisors “for the specific purpose of committing crimes against the public administration”.

The PGR requested the taking of statements from Janones and former advisors who accuse him of practicing rachadinha. Furthermore, the deputy attorney requested that the Chamber of Deputies send the STF detailed information about all advisors who have already worked and who still work in the parliamentarian’s office. Janones denies any wrongdoing and called the accusations “fake news” and blamed the “extreme right”.
