The defense of the former head of the Operational Department of the PMDF, alleged “possible constraints”

Brasilia DF) – The lawyers of Jorge Eduardo Naime, former head of the Operational Department of the Military Police of the Federal District (PMDF), asked the Federal Supreme Court (STF) that the colonel not be required to attend the CPI of 8/1. The request for safe conduct, according to the defense, aims to prevent the colonel from suffering “constraints” emanated by the members of the Joint Parliamentary Commission of Inquiry, held in the National Congress.

The request to hear Jorge Eduardo was authored by Eliziane Gama (PSD-MA), rapporteur of the CPI of 8/1. He is expected to appear at the CPI as a witness this Monday (26). In the document, the parliamentarian mentions the importance of hearing the colonel about the attempted invasion of the Federal Police headquarters, in Brasília, on December 12 of last year. The commission investigates the escalation of the coup, based on the result of the presidential election, on October 30.

“Within the first phase of the hearing of witnesses, the questioning of Mr. Jorge Eduardo Naime, former head of the Operational Department of the Military Police of the Federal District, is requested as a witness, under commitment, of the acts that took place in Brasília on the last 12th of December. It is thought that Mr. Jorge will bring information of enormous value to the conduct of our future work in the present Commission”

However, Naime’s defense filed a writ of habeas corpus asking, on a preliminary basis, that he is not obliged to appear or that he may withdraw at any time. In addition, the lawyers request that the colonel be able to consult them at any time during the deposition and/or remain silent.

If Naime is actually heard as a witness, he is obliged to speak. If he goes as investigated, he can be silent.

Stuck

Naime was arrested on February 7, in the fifth phase of Operation Lesa Patria. He and other police officers detained by the PF are being investigated for their work on the day of the terrorist attacks against the headquarters of the Three Powers, in Brasília.

In May, Minister Alexandre de Moraes, of the Federal Supreme Court, denied the colonel’s defense request and maintained his arrest. As he is still being held, it is necessary to organize logistics to make his testimony at the CPI feasible.

Jorge Eduardo Naime was head of the PMDF’s Department of Operations (DOP) and was off duty on January 8, having been replaced a few days earlier by Colonel Paulo José Ferreira. On the day of the anti-democratic acts, Naime even went to the Esplanada dos Ministérios, arrested demonstrators and was injured by a rocket.

On January 10, he was exonerated by Ricardo Cappelli, who was then an intervenor in public security in the Federal District.
