Former mayor of Nhamundá must return R$ 122,700 to public coffers

The TCE-AM determined that the person in charge at the time, the former President of the Legislative House, Geraldo Afonso Bindá, should return approximately R$ 122,700 to the public coffers.
Nhamundá (AM) – The Amazonas Court of Auditors (TCE-AM) judged, on the morning of this Thursday (23), the accountability of the Municipality of Nhamundá in the 2018 financial year as irregular. It was determined that the then responsible, the former President of the Legislative House, Geraldo Afonso Bindá, return about R$ 122,700 to the public coffers.
The session was conducted by the president of TCE-AM, counselor Érico Desterro, and was broadcast live through the TCE-AM profiles on YouTube (TCE Amazonas), Facebook (/tceamazonas) and Instagram (@tceamazonas).
According to the voting proposal of the auditor-rapporteur Luiz Henrique Mendes, followed unanimously by the directors, despite the fact that there is no evidence of abusive expenses or with indications of malpractice in the records, expenses with fuel in the amount of R$ 102 thousand were identified without any control accounting, without the use of methods such as spreadsheets, maps, daily and monthly reports on the release of fuels and lubricants, including the identification of benefited vehicles, by means of make, model and license plate, for example.
“I understand that the indicated payments lack documents that prove that this fuel was used observing the public purpose, as well as its effectiveness”, highlighted the auditor-rapporteur Luiz Henrique Mendes”.
The manager has 30 days to pay the amounts owed, or to appeal the decision of the Full Court.
Also during the session, the councilors disapproved the bills for the 2017 fiscal year of the Municipal Council of Silva, and determined a fine of R$ 86,000 to the responsible person, the then president Julimar Neves Grana, who will also have 30 days to pay the amounts due or to appeal the decision of the Full Court.
In her vote, rapporteur-counselor Yara Lins dos Santos highlighted improprieties as illegitimate and uneconomic acts that resulted in damage to public coffers, including payment with human resources above the maximum limit of 70% of the Chamber’s revenue; the absence of control of fixed assets; payments without corresponding settlement, among others.
In all, 21 cases were judged during the 4th Ordinary Session, six of which were annual rendering of accounts; four representations; five features; three survey audits; a complaint and an embargo of declaration.
The session was led by CEO Érico Desterro, with the participation of directors Yara Lins dos Santos and Josué Cláudio, in addition to auditors Mário Filho and Luiz Henrique Mendes. The Public Ministry of Accounts (MPC) was represented by attorney Elissandra Monteiro.
The next session will be held on February 28th, starting at 10:00 am, with a live broadcast on the TCE-AM profiles on YouTube (TCE Amazonas), Facebook (/tceamazonas) and Instagram (@tceamazonas).
