Brasilia DF) – Federal Supreme Court (STF) Minister Alexandre de Moraes maintained the trial of the next defendants on January 8th in a virtual plenary session.
The decision came after a request from the Brazilian Bar Association (OAB), which challenged the decision of the president of the STF, minister Rosa Weber, to judge the defendants who participated on January 8th in the virtual plenary.
The entity filed a request for cases to be analyzed online only with the consent of the lawyers in the case in question.
The argument is that the compulsory trial, without the option of taking place in a physical plenary session, violates “due legal process, the adversarial process and the right to defense”. The physical plenary session ensures that lawyers have the opportunity to carry out oral arguments in real time in a clear and effective manner.
The OAB also reinforces that reconsideration is necessary “given the relevance and exceptionality of criminal actions”.
By deciding to send the trial of the January 8th defendants to a virtual plenary, Rosa Weber responded to a request from the case’s rapporteur, Minister Alexandre de Moraes. The OAB request was also sent to his office.
CNN has already shown that the first trials in the physical plenary session would allow the Court’s ministers to establish a legal thesis to be followed in the criminal actions of the other defendants in the coup acts.
In total, the STF received 1,345 complaints, but some of them are suspended for 120 days by decision of Moraes so that the PGR can analyze whether or not to propose Criminal Non-Prosecution Agreements (ANPP).
First wave of defendants
Last week, the STF began trials of people who participated in and financed the criminal acts of January 8th with a group of four people.
The defendants Aécio Lúcio Costa Pereira and Matheus Lima de Carvalho Lázaro, who invaded the National Congress, were sentenced to a 17-year sentence for five crimes. The third defendant, Thiago Mathar, who vandalized the Palácio do Planalto, was sentenced to 14 years.
The 4th person to be tried is Moacir José dos Santos, 52 years old, resident of Cascavel, Paraná. He is the only one of the first four defendants to respond to the case in freedom, by decision of Minister Alexandre de Moraes, at the beginning of August.
