Federal Police comply with warrants against Carla Zambelli and hacker Walter Delgatti, says TV

Five search and seizure warrants and one preventive search were carried out in São Paulo and the Federal District this Wednesday (2nd) by the Federal Police’s Operation 3FA. According to the first information, the federal deputy Carla Zambelli (PL-SP) and the hacker Walter Delgatti are the targets, according to the investigation of GloboNews. According to official information released by the authority, the operation aims to “clarify the performance of individuals in the invasion of the systems of the National Council of Justice (CNJ) and the insertion of false documents and release permits in the National Bank of Arrest Warrants ( BNMP)”.

Two search and seizure warrants and one preventive arrest warrant are being served in the state of São Paulo and three search and seizure warrants in the Federal District, in addition to analyzing the seized material. Pretrial detention would be for Delgatti, who had been at liberty using an electronic ankle bracelet since July 10 after being arrested at the end of June for the second time.

Delgatti became known as the “Vaza Jato hacker” for invading the cell phones of authorities involved in Operation Lava Jato. He was initially arrested in July 2019 during Operation Spoofing, in which investigations point to access to Telegram messaging app accounts.

The search and seizure warrants against the deputy are carried out in her office in Congress and in her functional apartment in Brasília and at her residence in São Paulo.

“The actions take place within the scope of a police investigation instituted to investigate the invasion of the CNJ system, which was processed before the Federal Court, but had a decline in competence for the Federal Supreme Court (STF) due to the emergence of evidence of possible involvement of a person. with prerogative of forum”, says the PF.

The crimes investigated would have occurred between January 4 and 6, 2023, when data would have been entered into the CNJ system and, possibly, from other courts in Brazil. “Eleven permits for the release of individuals arrested for various reasons and a false arrest warrant in disfavor of the Minister of the Federal Supreme Court Alexandre de Moraes”, says the authority.

The alleged fraudulent insertions would have occurred after an invasion of the systems, using false credentials obtained illegally, “conduct through which the criminal(s) gained remote control of the systems”. The facts investigated configure, in theory, the crimes of invasion of a computer device and ideological falsehood.

Deputy Carla Zambelli has not yet commented on the operation this Wednesday (2).

On social media, Minister Flávio Dino, of Justice, justified the operation launched by the Federal Police.

“In continuation of actions in defense of the Constitution and the legal order, the Federal Police are complying with court orders relating to invasions or attempted invasions of computerized systems of the Judiciary of the Union, in the context of attacks on institutions”, he said.

Analysis in the Ethics Council

In addition to the operation of the Federal Police, Carla Zambelli will have a representation analyzed by the Council of Ethics of the Chamber of Deputies this Wednesday (2).

The parliamentarian is the target of a representation presented by the PSB (see in full) and has deputy João Leão (PP-BA) as rapporteur. The party accuses the deputy of breaching parliamentary decorum for having cursed and embarrassed deputy Duarte (PSB-MA) during an audience with Minister Flávio Dino on April 11.

The behavior, according to the PSB, “reduces Parliament to a circle of informal conversations, where anyone can offend without being reprimanded”. The representation adds that parliamentary immunity is a protection of democracy and should not be used in an “immoral and mocking” way.
