Popular action was filed in March by a parliamentarian from Novo. For the judge, documents used to prove the required experience were not enough. The substitute judge of the 1st Federal Court of the DF, Marcelo Gentil, determined this Thursday (25) the temporary removal from office of Fukunaga, president of Previ, the pension fund for Banco do Brasil (BB) employees. The decision was given in popular action filed by state deputy of São Paulo Leonardo Siqueira (Novo). In the action, the congressman questioned Fukunaga’s professional career and his ability to hold office. Siqueira also asked that the certificate of technical capacity given by the National Supplementary Pension Superintendence (Previc) to the president of Previ be annulled. The certificate is a necessary condition for exercising the position. The judge understood that the documents presented by Fukunaga to obtain the certificate did not prove the experience required for the position. In view of this, he decided to annul the qualification certificate — and, consequently, the need to provisionally remove Fukunaga from office. “In addition to the probability of the right, demonstrated according to the reasoning above, the danger of delay is also present, in the face of the presumed damage in the perpetuation of the effects resulting from the act that is considered harmful to public morality”, says the judge. Federation also contested nomination In March, the Federation of Associations of Retired and Pensioners of Banco do Brasil (FAABB) demanded that BB explain the criteria that led to the nomination of trade unionist João Fukunaga to chair the fund. Previ is the pension fund for Banco do Brasil retirees and pensioners. According to the institution’s website, it is among the largest pension funds in Latin America.
