Fachin will inherit Vaza Jato’s report in the Supreme Court – 04/27/2023 – Panel

The President of the Federal Supreme Court, Rosa Weber, appointed Minister Edson Fachin as the rapporteur for Vaza Jato after the retirement of Ricardo Lewandowski, who was responsible for this agenda in the Second Panel of the court.

The nomination is provisional, until Lewandowski’s replacement is sworn in at court. In theory, the new minister inherits the processes of the outgoing minister, but this is unlikely to happen if the chosen one is President Luiz Inácio Lula da Silva’s (PT) lawyer, Cristiano Zanin.

As Zanin was an active part of the processes related to Vaza Jato, he must be declared impeded, and therefore the case will be redistributed by lot.

The choice of the new rapporteur was determined by Rosa in response to a query made by Fachin himself. The criterion was that, according to the STF regiment, the position would fall to the most recent minister in the Second Panel after Lewandowski.

There are currently around 20 requests from Lava Jato targets to extend to them the decision to annul charges against Lula that were based on Odebrecht accusations. Among them are, for example, the former governor of Rio de Janeiro Sergio Cabral and the lawyer Rodrigo Tacla Duran.

A critic of Lava Jato, Lewandowski had been granting these extensions, but Fachin, who was the rapporteur for the operation at the STF and is more sympathetic to it, may have a different attitude.
