Minister Edson Fachin, of the Federal Supreme Court (STF), voted this Thursday (27) in favor of making defendants over 200 denounced by the Attorney General’s Office (PGR) for alleged participation in the acts of January 8, in Brasília. He followed the vote of rapporteur Alexandre de Moraes and joined Dias Toffoli in the decision. With that, the score of the vote is 3 to 0.

The trial, which takes place in the virtual plenary, began this Tuesday (25) and runs until May 2. The Court is analyzing the investigations that judge the intellectual authors (4921) and the executors (4922) of the acts of vandalism that resulted in the invasion and depredation of the headquarters of the Three Powers.

Moraes stated, in the vote, that the PGR proved the practice of “multitudinous crimes”, that is, those practiced by a large number of people with a “subjective bond” of action by “imitation or suggestion”.

“There is no doubt, therefore, that in the acts of January 8, 2023, all acted in a concurrence of people, united by the subjective bond to carry out the common work, and must be strictly responsible for their actions”, he said.

On Monday (24), the Supreme Court ministers concluded the analysis of the first wave of complaints filed by the PGR and, by majority vote, decided to make 100 accused defendants. And they have already scheduled the next session to judge the complaints of over 250 people, starting next Wednesday (3).
