Erika Hilton sues Moraes against Nikolas for transphobia – 03/13/2023 – Mônica Bergamo

Federal deputy Erika Hilton (PSOL-SP) sent to STF (Supreme Federal Court) Minister Alexandre de Moraes a request for the adoption of precautionary measures against Nikolas Ferreira (PL-MG), her colleague from the Chamber of Deputies. The parliamentarian asks that the Bolsonarist have his profiles on social networks suspended to prevent the spread of alleged false news against trans people.

Hilton claims that, since he made a transphobic speech in the plenary of the Chamber of Deputies on Women’s Day, the PL deputy has shared videos that reproduce his speech, reiterated his position and shared manifestations of personalities who came out in his defense.

In the petition presented to the STF, Hilton lists 19 publications made by the parliamentarian in different social networks about the episode or attacking transgender people.

To Minister Alexandre de Moraes, the deputy asks that Nikolas be included in the fake news inquiry opened by the court for inducing Brazilians “to an untrue narrative regarding the population of trans and transvestite women”.

“By presenting this speech to millions of virtual followers, the deputy promotes a complete distortion of his public role, spreading false information about the gender identity of a significant number of Brazilian citizens”, says Erika Hilton, one of the first trans people elected for the National Congress.

According to a survey carried out by the parliamentarian’s team, the Bolsonarist deputy gained more than 290,000 new followers on Instagram and more than 40,000 on Twitter since he spoke in a wig in the plenary of the Chamber and mocked the existence of trans women.

“It is evident that Deputy Nikolas Ferreira, in addition to maintaining constant criminal activity by spreading false news, transphobia and incitement to transphobia across all of his social networks, is still intentionally taking advantage of the criminal practice”, says Hilton.

In addition to the suspension of Nikolas’ networks until his responsibility for the alleged practice of transphobia is determined, Erika Hilton asks the Supreme Court to determine the removal of all posts by the deputy that “bring lying and transphobic content about the trans and transvestite population “.

“The behavior of deputy Nikolas Ferreira, with regard to transphobia, is recurrent and outrageous to the legal order in the country, as well as to the justice institutions. Even though he has already been investigated for the practice of transphobia in at least two other cases, the deputy deliberately chose to make an offensive and criminal speech on March 8,” says the parliamentarian.

Last week, when speaking about the reactions to his speech in the Chamber of Deputies, Nikolas defended himself and stated that there was no transphobia.

“I defended the right of women not to lose their space in sports for trans people —in view of the biological difference—and not to have a man in the women’s bathroom. There is no transphobia in my speech. I clarified the example with a wig (shocking). going beyond that is hysteria and narrative,” he wrote on the networks.

In 2019, the crimes of transphobia and homophobia were equated to the crime of racism by the STF.
