Entities ask for Congressional action against eventual release of abortion and drugs by the STF

Civil society entities and parliamentary fronts released this Thursday (31) an open letter to the Federal Supreme Court (STF) and a request for action to Congress on the Court’s performance. According to the entities, “recent manifestations” of the STF have “the clear purpose of absorbing responsibilities pertinent to Congress, with the aim of legislating on abortion and drugs”.

The letter cites a lawsuit filed by the Psol (ADPF 442) which, according to the entities, has the “objective of decriminalizing abortion up to the 12th week of gestation, regardless of the condition of the human person being generated, leaving the hypotheses of non-incidence of punishment provided for in the Penal Code”. With regard to the judgment on the possession of drugs for personal consumption, the entities point out that the act of possessing drugs “constitutes a crime” according to the law. “However, to date, 5 of the 11 ministers have already voted in favor of decriminalizing drug possession”, they point out.

The entities ask that the president of the Senate, Rodrigo Pacheco (PSD-MG), and of the Chamber, Arthur Lira (PP-AL), take the “appropriate measures to curb the judicial activism of the STF”, especially in the mentioned subjects. “The National Congress cannot omit itself from this debate, it must call it upon itself, demonstrating that the issues have already been and continue to be debated by the representatives elected by the people. The presidents of the legislative houses must unequivocally demonstrate to the judiciary what their role is, constitutionally foreseen, and not merely submit to the Federal Supreme Court”, they defend.
