Electoral action against Moro exposes pre-campaign with defendant PM – 11/01/2023 – Power

One of the documents attached by Podemos to the process that could lead to the revocation of the mandate of senator Sergio Moro (União Brasil-PR) reveals the role, in the former judge’s pre-campaign team for the Presidency of the Republic, of a military police officer who is defendant on charges of murder.

In the electoral investigation action being processed at the TRE (Regional Electoral Court) of Paraná, parties were ordered to present proof of payments related to Moro’s pre-campaign — who was affiliated with Podemos before migrating to União Brasil.

Defendant along with three other police officers for the death of two young people in 2016, while they were on duty, and also under accusations of forging a confrontation and planting weapons and drugs in the victims’ car, Sergeant Gledson Guaraci Pereira Apolinário appears among the names they had plane tickets and hotel rates paid by Podemos. In the criminal action, he and the other police officers claim to have acted in self-defense and in strict compliance with their legal duty.

Questioned by Sheet Regarding Apolinário’s presence among the travel expenses, the party reported that he was a security guard for Moro’s team.

According to regulations of the São Paulo Military Police, acting as private security for those on active duty is a serious disciplinary offense.

When contacted by the report, Apolinário said, via email, that he had nothing to declare. Earlier, in a phone call, he stated that he served “sometime when he [Moro] came here in São Paulo”, but he would have only acted as “driver, something like that” — the call was ended in seconds and he did not answer the calls again.

The Public Security Secretariat of the state of São Paulo, in turn, stated in a statement that the case will be investigated. “This is because Complementary Law No. 893, of March 9, 2001, classifies as a disciplinary transgression the exercise of a private security function or any activity outside the Police-Military Institution that harms the service or employs State resources,” he said. the organ.

In a note to Sheet, Moro’s office stated that “the hiring in question was carried out directly by Podemos and not by the senator, who did not know the company or the person referred to”. Adding that “the party is responsible for the contracts signed”.

Podemos stated that questions about Apolinário should be directed to the company.

The acronym’s accounts include payments to Pleg Seg Assessoria from November 2021 to March 2022, totaling just over R$239 thousand.

The company’s CNPJ, which has the police officer’s daughter as managing partner, is registered at the same address as another CNPJ in the name of Apolinário.

Until the publication of this report, Pleg Seg had not responded to the questions sent — including whether the sergeant had any contract or relationship with the company.

Apolinário and three other police officers were charged by the São Paulo Public Ministry for the death of two young people in São José dos Campos while they were on duty, on a night in November 2016.

“The homicides were committed using a resource that made the victim’s defense difficult, since the offended parties, who did not carry firearms and did not show any reaction, were executed with several shots”, says an excerpt from the complaint, received by the State Court in December 2019.

The police officers are also accused of having simulated a confrontation with the young people and of having placed, inside the car in which the two were traveling, a backpack containing drugs and items such as a precision scale, as well as a cell phone and two firearms.

After hearing the witnesses and defendants, in July 2021, the judge admitted the action to continue, the next stage of which is the trial in the jury court.

“A superficial analysis of the evidence collected is enough to verify the presence of the elements authorizing the pronouncement of the decision to pronounce the crimes of qualified homicide and related crimes”, says the decision that assessed the existence of evidence of materiality and sufficient signs of authorship.

Apolinário’s defense, who is represented in the action by lawyers Renato Soares and Mauro Ribas, told the report that he was “calm about the innocence of all the police officers” and that, according to the evidence in the case, Gledson “acted in self-defense and this will be fully demonstrated in the jury trial.” According to the defense, at the administrative level the process would have been archived.

In the action at TRE-PR, the daily allowances and tickets in Apolinário’s name appear in a 334-page document sent by Podemos on October 23rd – after the action’s rapporteur had already scheduled the testimonies of the witnesses and those investigated in the action.

As a result, Moro’s defense requested the withdrawal of both this document and a batch totaling 868 pages added on October 17, under the argument that they had been done after the appropriate deadline.

The case rapporteur agreed to reschedule the hearing dates, but added that he would decide on removing the files after analyzing their content.

The PL of Paraná and the federation formed by PT, PV and PC do B, which filed the lawsuits against Moro, allege that Moro’s expenses and exposure as a candidate for the Presidency led to an imbalance in relation to the dispute for the Senate.

The senator’s defense denies the accusations and says that the investigation is political in nature.
