Dino triggers PF to investigate Lava Jato agreements with other countries

The Minister of Justice, Flávio Dino, activated this Monday (24) the Federal Police to investigate the agreements signed between the former Lava Jato prosecutors and the American authorities. The information about the negotiation was released by the portal UOLon the 20th, based on messages obtained by the PF during Operation Spoofing.

In this operation, which became known as “leak jet”, the police investigated the hacking of messages exchanged between prosecutors and also with former judge Sergio Moro (União-PR).

“Today I forwarded to the Federal Police the case of agreements made by prosecutors with other countries, without the legal procedure. The objective is the investigation into the origin and destination of billions of reais and the reasons that led to such agreements with foreign authorities”, said the Minister of Justice at the twitter.

Moro, who was elected senator, countered Dino’s decision and said that the investigation will be opened based on “illicit evidence”. “The Minister of Justice asks the PF to initiate an investigation based on illegal ‘evidence’. A shame. Rule of law thrown out the window. Nor am I going to discuss the merits of the agreement, in fact approved at the time by the Superior Council of the MPF and praised internationally”, said the former judge.

According to the assessment of portal UOLformer attorney and former deputy Deltan Dallagnol (Podemos-PR) negotiated in secrecy with the US authorities an agreement to share the money that would be collected from Petrobras in fines and penalties due to investigations into corruption.

After publication, still on the 20th, Dallagnol posted on twitter a note explaining how, according to him, the agreements worked. Read the former attorney’s statement in full:

Settlement negotiations have always been treated confidentially for various reasons in the public interest, which include preserving the interests of the investigation and recovery of assets, as well as promoting, in the appropriate manner and time in accordance with the corporation law, the disclosure of information to the market.

2. The agreement between the MPF and Petrobras had diffuse rights as its object, which, contrary to what the journalist assumes, is the responsibility of the MPF and not of the CGU, which is further evidence of the lack of investigation and context with which journalists have approached the subjects addressed in the alleged messages.

3. Lava Jato prosecutors do not recognize the alleged messages obtained through crimes, without attested authenticity and used without ethical criteria by several journalists, who have disclosed legitimate activities of public officials in a distorted way, without adequate verification of the context and turning a blind eye to the seriousness of crimes against fundamental rights committed by hackers”.

On the same day, Moro shared Dallagnol’s note and classified the report by UOL on the topic as “a sensationalist factoid about Lava Jato”. “Some UOL journalists produced yet another sensationalist factoid about Lava Jato. Why didn’t they criticize the MPF’s leniency agreement with Odebrecht/Braskem in 2016 when the terms were made public?”, questioned Moro.
