The Minister of Justice, Flávio Dino, said this Tuesday (15) that “society has called on the Judiciary to activism” and that the government is discussing a project to regulate social networks. The statements were given during an event promoted by the BTG Pactual bank, in São Paulo.
During the panel, Dino questioned whether the Judiciary “is an activist because it wants to or is an activist because it is invited to do so”. “More than invited, summoned. Summoned by whom? For society,” reports the Folha de S. Paulo.
For the minister, the Judiciary led to this activism due to the political crisis and economic litigation in the country. “It is unfair at this point to attribute to the Judiciary a kind of undue interference in the political and economic game. I would say that, more especially, the Judiciary was led to this, and I can say that the results were more positive than negative”, he added.
“Very likely, we will have some time that this protagonism of the Judiciary will be preserved”, said the minister.
Flávio Dino also argued that the discussion of regulating social networks is not about curbing the freedom of expression of opinions or even fake news, but about crimes. “There is an understanding that absolute freedom of expression does not exist. It’s not me who says that, it’s the Penal Code, ”he said.
According to the minister, the platforms already control posts on social networks, but following “their own criteria”. For him, due to the advancement of technology, there must be government control.
